The tense-zone rent control is being extended to new municipalities

Since 25 November, 24 municipalities in the Basque Country have had to apply the rent ceiling. A Prefectural Order of November 21, 2024, sets this out following a sharp increase in rental prices in this geographic area. What is the rent control and where does it apply? Service-Public.fr informs you.

The municipalities of the Basque Country authorized to apply the rent guidelines in accordance with this Prefectural Decree are: Ahetze, Anglet, Arbonne, Arcangues, Ascain, Bassussarry, Bayonne, Biarritz, Bidart, Biriatou, Boucau, Ciboure, Guéthary, Hendaye, Jatxou, Lahonce, Larressore, Mouguerre, Saint-Jean-de-Luz, Saint-Pierre-d'Irube, Urcuit, Urrugne, Ustaritz and Villefranque.

The Framework applies to all rental agreements signed as of 25 November 2024, as soon as it is a residential lease (the tenant uses the rental as the main residence) or a mobility lease. The rent (excluding charges) per square meter of living space of the dwelling shall not exceed the increased reference rent as defined by the Prefectural Decree taken each year.

Empty and furnished rentals are concerned: relocations, first rentals (including flats) and lease renewals.

National experimentation

The national rent framework was introduced on an experimental basis in 2018 with the housing, development and digital development act. In 2022, it is being extended until 2026 the law on differentiation, decentralization and deconcentration.

The scheme is being implemented in several cities and intercommunalities:

  • Bordeaux
  • Lille, Hellemmes and Lomme
  • Lyon and Villeurbanne
  • Montpellier
  • Paris
  • Territory of the Basque Country
  • Eastern Territory Together
  • Common Plain Territory

Reminder

Rent controls are a device introduced in certain geographical areas to limit the increase in rents when renting a dwelling with a dwelling lease (including a mobility lease). It applies in municipalities located in stretched areas. A tense area offers for rental a much smaller number of dwellings than the demand for dwelling as a principal residence.
