Recruitment of a Contractor in the State Public Service (EPF)

State civil service jobs are normally filled by civil servants.

However, in certain cases, which are exhaustively listed by law, State administrations and their public establishments may recruit contract agents.

The duration of the contract (fixed or indefinite) depends on the reason for recruitment.

We present you the various possible cases.

You can be recruited as a contractor when there is no body civil servants to perform the functions sought.

The employment may be category A, B, or C.

The job offer is published on the website Public employment.

It states that employment is open to contractors.

You can be recruited on a permanent contract or a permanent contract.

If you are recruited on a fixed term

If you are recruited on fixed-term contracts, the duration of your contract cannot exceed 3 years, renewable up to a maximum of 6 years.

If your contract is renewed after 6 years, it can only be renewed in a DTA.

When you are recruited, if you already have 6 years of public service in the same hierarchical category as the job you are recruited for, you are directly recruited on a permanent contract.

Previous functions of the same hierarchical category may have been performed in the State or territorial civil service or in the hospital civil service.

If, before the end of your fixed-term contract, you prove that you have had 6 years of public service in the same hierarchical category, your contract is considered to have been concluded as a fixed-term contract.

Your employer administration sends you a proposal for an amendment to your contract confirming its indefinite duration.

If you refuse to conclude this amendment, you will remain in office until the end of your term of office.

How is the 6-year period counted?

The 6-year period shall be counted taking into account all services performed in the following jobs or occupied for the following reasons:

  • Jobs in State public institutions
  • Lack of government officials to perform the functions sought
  • Recruitment justified by the nature of the duties or the needs of the services
  • Employment falling within a body whose status does not provide for compulsory initial training prior to establishment
  • Incomplete employment
  • Temporarily replacing an absent agent

The six-year period must have been completed in full by the same ministerial department, public authority or public institution.

Part-time and incomplete services shall be treated as full-time services.

Services performed on a discontinuous basis are taken into account, if the duration of the interruptions between 2 contracts does not exceed 4 months.

For the calculation of the duration of interruption between 2 contracts, any period of health emergency is not taken into account.

You may be recruited as a contractor when the nature of the duties or the needs of the service warrant it.

This is particularly the case in one of the following situations:

  • Functions requiring specialized or new technical skills
  • Absence of an official with the relevant professional expertise or experience to perform the tasks

The employment may be category A, B, or C.

The job offer is published on the website Public employment.

It states that employment is open to contractors.

Your application will only be examined when the administration has established that there is no official who fits the profile sought.

You can be recruited on a permanent contract or a permanent contract.

If you are recruited on a fixed term

If you are recruited on fixed-term contracts, the duration of your contract cannot exceed 3 years, renewable up to a maximum of 6 years.

If your contract is renewed after 6 years, it can only be renewed in a DTA.

Renewal of your contract is only possible once the administration has established that there is no official corresponding to the profile sought.

You can be recruited as a contractor for temporarily replace an agent (official or contract employee) on part-time or leave.

The contract shall be concluded for a fixed period.

It shall be renewable until the date of return of the staff member to be replaced.

You can also be recruited as a contractor on a temporary vacancy, awaiting the recruitment of an official.

The contract shall be concluded for a fixed period of time, up to a maximum of one year.

The contract may be extended, up to a maximum of two years, if the recruitment procedure has not been completed before its end date.

You can be recruited as a contract contractor on a fixed-term contract to cope with a temporary or seasonal increase in activity.

The total duration of the contract and any renewals may not exceed 6 months during a period of 12 consecutive months to cope with a seasonal increase in activities.

Incomplete-time jobs with a maximum weekly working time of 24 hours 30 hours may be filled only by contract staff.

You can be recruited by project contract to perform an identified project or operation.

The project contract shall be concluded for a minimum period of one year and a maximum period of six years.

It may be renewed to complete the project or operation, up to a total duration of 6 years.

Where the contract is concluded for a period of less than 6 years and the planned project or operation is not completed by the end of the contract, the contract may be renewed up to a maximum of 6 years.

The project contract shall end with the completion of the object for which it was concluded, after a period of advance notice.

It may, however, be terminated by decision of the employer's administration at the end of a period of one year if the project or operation for which it was concluded cannot be carried out.

If you are disabled, you can, under certain conditions, be recruited as contract on a fixed-term basis, then be established.

The employment may be category A, B, or C.

You can be recruited as a contractor under the Career pathways in the public service (Pact) if you are under 29 years of age and if you meet one of the following 2 conditions:

  • You do not have a recognized diploma or professional qualification
  • You have a lower qualification level than the bachelor's degree

You can be recruited on a category C job.

The purpose of the Pact is to enable you to acquire, through work-linked training, a qualification related to your job or the diploma required to access the framework of jobs to which your job belongs.

Your contract is concluded for a minimum of one year and a maximum of two years.

Your contract may be renewed for a maximum of one year if you have not obtained the qualification or diploma in question.

At the end of your contract, you are eligible to become a tenure holder and become a public servant.

An institution of higher education and research may recruit a university professor or a lecturer such as associated personnel or guest staff.

Associated personnel

A full-time senior lecturer or associate professor shall be recruited from CSD: titleContent from 6 months to 3 years maximum.

The CDD is renewable for a maximum of 3 years.

A half-time associate conference manager is recruited on a 3-year renewable 3-year term.

A part-time associate professor is recruited on CDD from 3 to 9 years.

The CSD is renewable up to a maximum of 9 years.

FYI  

the contract of a lecturer or associate professor who has refugee status may be renewed without limitation.

Guest Staff

Full-time or part-time visiting teachers are recruited on terms of study from 1 month to 1 year.

The following posts may be filled by contract staff:

  • Government management jobs
  • Jobs in State public institutions
  • University lecturer-hospital practitioner and university lecturer-hospital practitioner
  • Jobs as education assistant, boarding school teacher and day school supervisor in colleges and high schools

Senior posts for which the appointment is left to the Government's decision may also be filled by contract staff.

The list of these jobs is established by decree.

These include the posts of directors-general and directors of central administration, prefects, rectors of academies, etc.
