A male private counselor is a lay magistrate. Its mission is to settle disputes between employer and employee at the labor council.

When he is an employee, does he have time off to perform the duties of his job? Is he paid when he is absent from his company?

Yes, the male labor counselor may be absent from work to perform duties related to his or her position.

Activities related to the labor function include:

  • Taking of oath
  • Attendance at the formal opening hearing
  • Performance of administrative activities related to the functions of presidents and vice-presidents of the Council, Section or Chamber (if the employee holds such a position)

Jurisdictional activities include:

  • Preparatory study of a dossier
  • Participation in hearings
  • Participation in the deliberation

Please note

The male labor adviser may also benefit of leave authorizations for the purposes of his training.

This absence during working hours shall be treated as a actual working time for the calculation of employee entitlements. For example, calculating entitlements related to seniority or paid leave.

During his absence, the employee advisor shall receive a compensation.
