Can an employee receive unemployment benefit in case of resignation?

Your resignation may be considered legitimate if you complete the whole the following conditions:
- Your previous the contract was terminated in one of the following cases:
- Dismissal staff
- Dismissal economic
- Conventional breakage
- End of CSD: titleContent
- You did not register as jobseeker since your last employment contract was terminated
- You were hired in DTA: titleContent and you voluntarily terminated your new contract:
- Either less than 65 working days (3 months or 455 hours) after the date of hiring and if your resignation occurred before 1er april 2025
- Either less than 88 days worked (4 months or 610 hours) after the date of hiring and if your resignation occurred as of 1er april 2025.

If you meet all of these conditions, you can collect the RCA.
If your resignation is not considered legitimate, However, there are 2 options to be compensated under the ERA:
- You work at least 3 months (65 working days or 455 hours) after you resign
- After 121 days of unemployment (about 4 months), you can ask France Travail the review of your situation to get the ARE.
A regional joint authority (RPI) of France Travail is responsible for verifying that the following 2 conditions are met:
- Complete the conditions of award of the ARE (other than the condition of involuntary deprivation of employment)
- Provide evidence of your active job search, possible short-term job openings and your steps to undertake training.
If your request is accepted, the starting point for the payment of the AER shall be as soon as possible 122e day of unemployment.
