The decree n°2020-1310 of 29 october 2020 set list of establishments suitable for the public and the health protocol to be applied.

Depending on the local circumstances, the prefect of the department may adapt it. It can limit the number of clients that can be accommodated and prohibit the opening of markets, parks, gardens, beaches, water bodies and lakes in breach of sanitary protocol. It may make the wearing of the mask compulsory for persons over 11 years of age.

Accessibility is a legal obligation that allows everyone to have access to a place, a service, a facility, without discrimination. The conditions of access for persons with disabilities must be the same as those for able-bodied persons or, failing that, must have an equivalent quality of use.

The Scheduled Accessibility Schedule (Ad'AP) allows the manager or owner of a institution receiving public (ERP) or a publicly available facility (IOP) to carry out accessibility of its establishment. The latter undertakes to carry out and finance work within a specified period, in return for the lifting of the risks of sanctions. The procedure varies depending on the duration of the program and the number of establishments involved:

Unjustified failure to submit the Ad'AP project before 27 September 2015 is sanctioned.

A package of €1,500 shall be applied where the agenda relates to an establishment whose public number is below the threshold referred to in the safety and security regulations €5,000 in other cases.

The overrun time is charged to the duration of the scheduled accessibility schedule.

When the Ad'AP is validated, the work phase starts.

Agendas with a duration of more than 3 years must monitor the progress of their agenda by achieving:

If, at the end of the period granted, the work is not completed, you have the option to extend the official duration of the agenda. There are 3 cases where an extension can be requested:

  • the case of force majeure, defined as an "unpredictable, irresistible and external" event, which makes it possible to apply for an additional period of up to 3 years, renewable,
  • the financial difficulty in applying for an additional period of up to 1 year, not renewable,
  • the technical difficulty which makes it possible to apply for an additional period of up to 1 year, not renewable.

It is imperative that each request be reasoned and justified. The identified difficulty must be demonstrated, at the latest 3 months before the expiry of the approved Ad'AP deadline.

The following shall be punished:

  • the unjustified failure to transmit the follow-up documents,
  • the transmission of clearly erroneous follow-up documents.

A package of €1,500 shall apply where the agenda relates to an establishment whose public number is below the threshold referred to in the security and safety regulations €2,500 in other cases.

A finding of deficiency shall be pronounced by a reasoned order specifying the measure adopted by the administrative authority:

  • In the absence of any commencement of execution of the Ad'AP, the decision approving the Ad'AP is repealed and an alert to the public prosecutor is made.
  • In the event of a significant delay in the completion of the work for the Ad'AP period, an accounting provision corresponding to the amount of the work not carried out over the period due shall be made.

You can submit an application to modify an approved Ad'AP that is being implemented to:

  • integrate new ERPs into an existing Ad'AP (e.g. when acquiring new non-compliant ERPs),
  • amend the duration of the agenda if the maximum legal duration was not initially granted.

You must fill out the application form to modify an approved Ad'AP and send it to the prefect who approved the original Ad'AP. The administration has a maximum of 4 months to approve or reject this change request.

Within 2 months of the completion of the work, you must send a completion certificate.

You must transmit it to the prefect who has validated the Ad'AP and to each commission for the accessibility of the commune concerned.

A finding of failure to act shall be made by a reasoned order specifying the measure adopted by the administrative authority.

At the end of the work schedule, when the work commitments in the Ad'AP have not been met, a new schedule is developed. The timetable adjusts the time limits which may not exceed 12 additional months. The contracting authority is required to complete the work within the new schedule. An accounting provision not exceeding the amount of uncompleted work shall be made. A financial penalty for non-compliance with the Ad'AP commitments shall be fixed between 5% and 20% the amount of work still to be performed.

Failure to transmit the certificate of completion shall be punished.
