Remarkable buildings, emblematic monuments, original houses... You like architecture and you are used to taking pictures of the sites you visit. Do you ever wonder if you need permission to photograph these places?Public-service answers you.
If you do not unduly infringe on the owner's right to use or privacy, you may take photographs of his property without his authorization. A disorder must be justified by the owner (risk of identification of the place making possible a burglary, influx of tourists...).
When you take photos of a public building for purposes strictly reserved for your private use, the Intellectual Property Code states that you do not have to ask the architect for permission.
As an individual, you can distribute the photograph of an architectural work online without the prior consent of its author or its beneficiaries under the strict condition that it is not on a commercial site or hosting advertising (such as social networks, for example). Article 39 of the Law provides for this for a 2016 Digital Republic, supplementing Article L122-5 of the Intellectual Property Code.
