Business Security Agreement: extension until December 31, 2022

The employer must propose the CSP if:

• the company has fewer than 1 000 employees;
• or if the company (regardless of the number of employees) is in a recovery or judicial liquidation.

Employees wishing to benefit from it must:

• provide proof of at least 88 days or 610 hours worked in the last 24 months or, in the case of employees aged 53 or over, in the last 36 months preceding the termination of the employment contract:
  
  • employees who have been employed in the company for 1 year or more shall be compensated under the occupational security allowance;
  • employees who have been employed in the company for less than one year receive an allowance equal to the return-to-work allowance.
• not have reached the age of 62 or, if so, do not justify the number of quarters required to receive the full pension (67 years for persons born on or after 1 January 1955;
• not to receive a conditional retirement pension;
• be fit for work;
• reside in the metropolitan area and in Guadeloupe, French Guiana, Martinique, Reunion, Saint-Barthélemy, Saint-Martin and Saint-Pierre-et-Miquelon.

The employee has a reflection period of 21 days, from the delivery of the document, to accept or reject the proposal.
