While a number of stolen items are sold at second-hand or attic stores, one senator reminds us of the obligation for organizers of these unpacking sales to keep a record of all sellers.
For its part, the Ministry of Economy and Finance confirms that these unpacking sales, authorized for individuals (up to a maximum of two per year), must be checked by means of a register identifying the sellers (professional and non-professional). Therefore, according to the Ministry, the organizers are obliged to keep a daily register detailing in particular the characteristics and provenance of the items sold and the identification of the persons selling or bringing these goods to the exchange. In case of non-keeping or forgetting to keep this register, the Ministry specifies that the organizers are liable to penalties (penalty of 6 months imprisonment and €30,000 of fine).
Reminder
Sales by unpacking which make it possible to sell goods, new or second-hand, by way of derogation may be made in places not specifically intended for sale.
