The right to share property after divorce or separation is currently set at 2.5%. It will be gradually decreased to reach 1.1% by 2022. That's what the 2020 budget law provides for.
Married couples or separating partners must share their movable or immovable property which they have acquired together or which they hold jointly. They must then pay a sharing fee (or registration fee). Since 2011, the rate of this duty is 2.5%.
From 1er january 2021, this rate will be reduced to 1.80% then to 1.10% from 1er January 2022. It will then be at the same level as it was before its increase in 2011.
Please note
This decrease only concerns . It does not change the rate applicable to the division of an estate or a change in the matrimonial regime.
