In this case, a tractor lost oil while traveling on the road. This caused a vehicle arriving behind him to skid and the driver to die. His relatives are seeking compensation for their loss of affection. The original judges ordered the owner and driver of the tractor to make good the consequences of the accident in which he was involved.
Officials are challenging the decision. They criticize the judges for not looking at how far the tractor was from the accident. According to them, the causal link between the oil leak and the accident was questionable. The tractor was several hundred meters ahead of the vehicle following it and was therefore not present at the scene of the accident.
The Court of Cassation rejected the argument and upheld the Court of Appeal's decision. It does not matter if the vehicles do not come into contact during the accident. It is sufficient that the vehicle played some role in the accident. In this case, an oil leak on the road.
