Retirement: a medical check-up for exposed employees
Publié le null - Directorate for Legal and Administrative Information (Prime Minister)
Since 1er october 2021, employees on retirement and who have held a position at risk to their health or safety, can benefit from an end-of-career medical visit organized by the employer. A decree issued in Official Journal on 11 august 2021, the terms of application of this visit and of the employees concerned shall be specified. The point with Service-Public.fr.
The employer will have to inform the occupational health service of the next departure or retirement of an employee who is or has been subject to enhanced medical care.
Who are the employees concerned?
The new medical examination concerns:
- employees who benefit or have benefited from enhanced individual monitoring of their health status;
- or those who have received specific medical follow-up due to their exposure to one or more particular risks prior to the implementation of the enhanced individual follow-up device.
In order to benefit from it, the employee must be exposed during his activity to risks affecting his health or safety: asbestos, ionizing radiation, lead, carcinogens, certain chemicals, hyperbaric risk, work at a height, etc. This visit makes it possible to establish a state of the art of exposures to one or more occupational risk factors and to determine better post-professional medical follow-up in the event of outbreaks of diseases delayed in time.
What's the procedure?
The employer must inform the occupational health service as soon as it becomes aware of the departure or retirement of the employee and inform the employee concerned of this without delay.
If the employer does not inform the occupational health service, the employee may, during the month preceding his retirement, request to benefit from this visit directly with this service. He must inform his employer.
The occupational doctor must determine whether the employee does indeed meet the conditions for the medical examination and organize it if these conditions are met. At the end of the visit, he must draw up a document setting out the state of play and, in the event of the employee's exposure to occupational risk factors, he may recommend, where appropriate, post-professional supervision in conjunction with the employee's doctor.
FYI
As of March 31, 2022, the implementation of post-professional supervision will be automatic if the employee has been exposed to risks, it will no longer be left to the initiative of the occupational physician.
