The Primary Health Insurance Fund (CPAM) may claim reimbursement of the benefits received by an insured person when he has made a journey during his sickness leave. This is what the Court of Cassation has just recalled in a judgment delivered by the Second Civil Chamber on October 21, 2021.
One insured person visited Algeria five times while on sick leave for almost two years and was receiving benefits from the Health Insurance. Ordered to repay all the sums paid, the Fund considers that the insured person had not complied with his obligations. He had to submit to the controls and respect the departure times authorized by the doctor.
The Court of Cassation ruled that all compensation could be claimed. However, it adds that the judge may moderate the claim so that it is appropriate to the extent of the misconduct committed.
