In the context of accompanying children out of school or participating in extracurricular activities, can the mayor of a municipality require volunteers (e.g. parents) to produce a criminal record certificate? It's a question from a senator at the Ministry of the Interior.
In its reply of 9 May 2019, the Ministry of the Interior recalls that the No. 2 Criminal Record Bulletin is issued to certain administrations (e.g. local authorities) for posts involving a habitual link with minors.
However, since volunteers are not considered to be persons employed by the communities, these provisions do not apply to volunteers accompanying school trips or to volunteers who come to help organize and operate school or after-school life.
On the other hand, the school principal or head of school may ask volunteers in contact with minors to provide Bulletin No. 3 of their criminal record (extract which contains only the most serious convictions, in particular those for crimes and offenses exceeding 2 years' imprisonment without suspension and the penalties of prohibition of engaging in professional or voluntary activity involving habitual contact with minors).
