What's New in the Public Service

The first decree deals with the opening of government management jobs to non-public servants. It shall lay down the posts concerned, the procedures for selecting candidates for those posts and the conditions of professional experience required to fill them.

The second decree, which concerns the three public services (State, territorial and hospital), specifies the procedures for setting up a contractual termination procedure for public officials (civil servants and contract staff) wishing to agree with their respective administrations an agreement on the definitive termination of their duties or on the termination of their contract.

Finally, the third decree lays down the rules for calculating the minimum and maximum amount of the specific contractual termination indemnity.

The amount of such compensation may not be less than the following amounts:

• 1/4 months of gross remuneration per year of service for years up to 10 years;
• 2/5^e months of gross remuneration per year of service for years from 10 to 15 years;
• 0,5 months gross remuneration per year of service from 15 years up to 20 years;
• 3/5^e months of gross remuneration per year of service from the age of 20 up to the age of 24.

In addition, the maximum amount may not exceed a sum equivalent to 1/12^e the annual gross remuneration received by the staff member per year of service, up to a maximum of 24 years' service.
