In the event of an accident, the lack of control over his vehicle may lead to a reduction in the insurance company's compensation. This is what the Court of Cassation ruled in its judgment of December 12, 2019.
A motorcyclist was injured when he hit a vehicle stopped in front of him on the road. Subsequently, his compensation was reduced.
According to the Court of Cassation, when he was not able to stop in time, the driver had committed a fault justifying the reduction of his compensation. The traffic regulations state that the driver must remain in control of his vehicle at all times.
In 2014, the Court had already held that certain authorized behaviors, such as smoking or driving with high heels, could justify the company paying less compensation in the event of an accident, since these situations could prevent the execution without delay of maneuvers essential to driving.
