Rental of a furnished apartment: what are the obligations of the owner?

The landlord must provide the tenant with decent housing

This accommodation must:

• have at least one main room with a living area of 9 m² and a minimum ceiling height of 2,20 meters or a living space of 20 m³ ;
• do not constitute a risk to the safety or health of the tenant: air and water tightness of doors and windows, window guards in good condition, electricity and gas connections in accordance with safety standards, main rooms with sufficient natural lighting, possible and sufficient ventilation...
• do not harbor pests or parasites (rats, bed fleas, cockroaches...);
• meet a minimum energy performance criterion: protection against parasitic air infiltration, adequate air tightness of doors and windows overlooking the outside...
• include certain equipment: drinking water supply, heating system, drainage system, kitchen or kitchen area, separate toilet from the kitchen or dining room, electrical network allowing adequate lighting of all rooms and access as well as the operation of everyday household appliances essential to daily life...

The landlord must provide the tenant with an equipped accommodation

For all leases signed after August 2015, the dwelling must be equipped with the following:

• bedding with duvet or blanket;
• shutters or curtains in the rooms;
• hotplates, ovens or microwave ovens, refrigerators, freezers or freezer compartments of the refrigerators with a maximum temperature of -6°, sufficient tableware for occupants to take meals, kitchen utensils;
• table and seats;
• storage shelves;
• luminaires;
• household maintenance equipment adapted to the characteristics of the housing (vacuum cleaner if there is carpet, broom and mop for tiles...).

Other obligations of the owner

• The landlord cannot enter the dwelling to check its maintenance status or have it visited without the agreement of its tenant. Before doing any work in the apartment, he has the obligation to inform the tenant of their realization.
• He must provide a rent receipt attesting that the tenant has paid the rent and expenses in full. It is transmitted free of charge and can be sent by email if the tenant gives his consent.
