Disability pension: what are the consequences if your health changes?

If your health changes, that is, if it worsens or improves, your disability pension can be adjusted upwards or downwards.

A check on your entitlement to your pension is carried out each year by the body which pays it to you (CPAM: titleContent or MSA: titleContent).

If you are employed, the check can be carried out every quarter.

This will provide you with a status and resource statement to complete and refer to CPAM or MSA.

In case of aggravation

If your condition worsens and justifies your placement in another disability category, the amount of your pension can be reviewed. This review shall be carried out by the CPAM: titleContent or the MSA: titleContent according to this new category.

You are notified of the review decision by letter RAR: titleContent.

The new amount of your disability pension is paid from the date of recognition of the worsening of your health.

Example :

If you filed your return in September 2021 but the aggravation dates from June 2021, your social security organization will make up the new amount owed to you as of June.

Warning  

if you do not attend the medical examinations requested by the CPAM or the MSA: titleContent, your disability pension may be suspended or terminated.

In case of improvement

Your income is over 50% of the disability pension

If your income is more than 50% of the normal remuneration received by a worker in your class, one of the following decisions may be made:

  • Your disability pension is canceled if the CPAM: titleContent or the MSA: titleContent believes that improving your health is permanent
  • Your disability pension is suspended if the improvement in your health does not appear to be permanent
  • Your disability pension is paid in part (up to 50%) if you are undergoing treatment, take courses or do retraining or re-education

The suspension or withdrawal of the pension may be immediate or fixed at a later date.

Other situation

If your condition improves and justifies your placement in another disability category, the amount of your disability pension is reviewed. This review shall be carried out by the CPAM: titleContent or the AMM according to this new category.

The new amount shall be paid on the first due date following the date of the decision of the CPAM or the MSA: titleContent.

You are notified of the review decision by letter RAR: titleContent.

For example, if your health improves in September 2021 when you file your return, and your pension is paid quarterly, your pension is revised for the next quarter (October 1). 

You will not be asked for a refund if your health improved the previous month.
