What are the rights of the employee whose employment contract is suspended?
During suspension temporary employment contract (e.g. sick leave, maternity or adoption leave), the employee does not work. However, he is bound by an obligation of loyalty to his employer. As such, the employee cannot harm his employer during the suspension of his contract:
- He cannot work for a competitor of his employer.
- He must respect an obligation of discretion. In particular, he does not have the right to disclose confidential company data to which he has access (e.g. manufacturing secrets).
If he does not meet these obligations, the employee may be dismissed..
