Power of attorney: A first step toward a fully online power of attorney
Publié le null - Directorate for Legal and Administrative Information (Prime Minister)
As of April 6, 2021, it is now easier to establish a power of attorney. You can use the new online service, My Power of Attorney, then go in person to the gendarmerie or police station with a proof of identity and the confirmation reference of the filing of the application online. This partly dematerialized system has been set up by the Ministry of the Interior for all elections that will take place from 11 April 2021 and in the perspective of the two departmental and regional elections in June 2021.
This procedure is complementary to the paper-based procedure, which is still possible if you cannot or do not want to use the digital channel. So you can still do the process according to these 2 other modalities:
- print the form available on the internetthen hand it over, in person and with proof of identity, to the gendarmerie or police station or to the court or to a place open to the public defined by the prefect;
- fill in by hand the form available on site (gendarmerie or police station or court, or place welcoming the public defined by the prefect) and present in person a proof of identity.
How's it going?
Want to establish a proxy? The new system is implemented in 3 stages:
- You make your power of attorney request on maproxy.gouv.fr after you have authenticated via FranceConnect and provided an email address. You indicate the municipality where you vote, the identity of the person who will vote for you and specify for which election or period you want to give power of attorney. Once you have validated your request, you will receive a 6-character reference by email.
- Equipped with this file reference and an identity document, you go to a police station or a gendarmerie brigade, regardless of its location. The judicial police officer (OPJ) or judicial police officer (APJ) authorized by the judge, enters the reference in a dedicated and secure digital portal. Your identity will then appear on the screen and will be checked against the identity document presented. Validation by the OPJ or APJ triggers the instantaneous transmission of the power of attorney to your registration commune.
- You will be notified by email as soon as your city council has validated your power of attorney.
Please note
When doing so, you do not have to prove the identity or address of the elector you designate to vote for you. You also do not have to provide proof of the reason for your power of attorney. Since June 17, 2020, proxy voting has been an unconditional open vote. It is therefore no longer necessary to justify the reason why you are unable to go to the polling station.
FYI
Throughout the procedure, you are informed by e-mail of the progress of the procedure and you are assured that your proxy is correctly taken into account, even if it is made shortly before the election.
Saving time and simplifying for everyone
This arrangement reduces the time needed to establish proxy voting for all actors in the chain:
- Voters, who can now apply online for power of attorney from a computer, tablet or smartphone.
- the 100,000 authorized police and gendarmes, before whom voters must always appear in order to limit the risk of fraud, but whose time spent drawing up powers of attorney will be considerably reduced;
- municipal services for which the processing of powers of attorney is dematerialized and simplified.
