National Caregiver Day (NCD)

Every year since 2010, October 6 has been a day of honor for caregivers. According to the Law on Adaptation of the business to Aging of 28 December 2015, a caregiver is a "person who regularly and frequently assists, on a non-professional basis, to perform all or part of the acts or activities of daily life of a person who is losing autonomy, due to age, illness or disability".

The objective of the event is to bring together, through meetings organized throughout the territory, all the actors who act for the cause of carers. Health care practitioners and home support workers can suggest actions to inform caregivers about their rights and the supports available to them.

What is Caregiver Leave?

Parent in severe loss of autonomy, sick spouse, child with disabilities... Caregiver leave allows you to suspend or reduce your professional activity in order to care for a loved one with a disability or a loss of independence. This leave has been compensated since October 2020. A decree issued in Official Journal of 24 july 2022 expands the scope of beneficiaries of compassionate care leave from 1^er July 2022.

The 2022 Social Security Financing Act provided for the extension of compassionate care leave to new beneficiaries, removing the condition of “particularly serious” disability or loss of autonomy of the assisted person. The implementing decree for this measure was published in Official Journal of 24 july 2022, the new provisions apply to entitlements opened and benefits due from 1^er July 2022.

Who can be considered a caregiver?

This leave covers all employees in the private sector, public sector employees, self-employed persons and job seekers who receive compensation.

Pensioners, unless they are doing something in addition to their retirement and reducing it to take care of someone who is losing their independence, cannot ask for it.

Caregiver leave is available under the following conditions:

• have a close and stable relationship with the person being assisted (spouse, cohabiting partner, past, ascending, descending, person with whom he resides or whom he regularly and frequently assists);
• the beneficiary and the person assisted must be resident in France;
• provide non-professional assistance in carrying out all or part of the activities of daily living;
• the assisted person must have a disability rate of 80% or more or receive a benefit (APA, third-party supplement, etc.).

Amount and duration of the daily caregiving allowance (AJPA)

The AJPA aims to compensate for part of the loss of salary, within the limit of 66 days during the employee's career path.

Its amounts are revalued every year to 1^er January, in direct reference to the amount of the net Smic in force on 1^er January of the year.

Since 1^er January 2022, the allowance is €58.59 per day and €29.30 per half-day. It is paid by the Family Allowance Funds (CAF) or the Mutualité sociale agricole (MSA).

The caregiver is entitled to a maximum of 22 YPGAs per month. The allowance may be paid half a day, except for job seekers.

At the end of the caregiving leave, the employee returns to his or her job or to a similar job with at least equal pay. He is entitled to a professional interview with his employer. He can also benefit from it before his leave.
