Telephone insurance: the withdrawal period is extended to 30 days

Good news for buyers of household appliances, electronics and especially mobile phones who purchase insurance or extended warranties unknowingly! The withdrawal period for insurance contracts sold in addition to goods or services is increased from 14 to 30 days. The time limit for waiving the insurance taken out at the same time as the purchase of the product is doubled since 1er January 2023.

An order of 5 December 2022 published in Official Journal of 13 december 2022 sets at 30 days the withdrawal period for “affinity” insurance sold in addition to goods or services from 1er January 2023. Until then, consumers had 14 days to cancel the contract free of charge.

You can therefore terminate this insurance contract or this extension of warranty for a period of 30 calendar days from its conclusion, free of charge or penalties. If you are entitled to one or more insurance premiums (months free), this 30-day period only runs from the payment of all or part of the first premium.

This right of waiver shall be subject to the following conditions:

  • you have entered into this contract for non-business purposes;
  • this contract is in addition to the purchase of goods or services sold by a supplier;
  • the contract you wish to renounce is not fully executed;
  • you have not claimed any claims under this agreement.

You no longer have to justify that you have an equivalent guarantee to break your contract.

To cancel the contract with the insurer, you must use a “durable medium”: letter, email or message from a customer account. Termination by telephone may not be taken into account.

The insurer is required to refund the premium paid to you within 30 days of your waiver.

The insurance contracts concerned are those covering:

  • the risk of malfunction, loss, including theft, or damage to the goods supplied (household appliances, computers, tablets, mobile phones, etc.);
  • damage to or loss of baggage, including theft, and other risks associated with travel;
  • the loss, including theft, of means of payment, as well as any other property included in an offer of means of payment.
