Measures to better support women after miscarriages

Implementation of a specific course of psychological care, facilitated sick leave. The bill to provide better care for women after miscarriages was finally passed by parliament on June 29. Service-Public.fr provides information on the outlines of this new law, which will take effect in 2024.

An accompanying journey

multidisciplinary

The law requires regional health agencies (RHAs) to set up a multidisciplinary course to support women and, where appropriate, their partners in the event of spontaneous termination of pregnancy. This journey must involve medical professionals and hospital and liberal psychologists.

The aim is to:

  • develop training for medical professionals on the psychological consequences of spontaneous abortions;
  • facilitate counseling, information and medical and psychological follow-up for women and their partners.

Daily allowances without waiting period

The legislation establishes a sick leave without day of deficiency for women who have had a miscarriage, differentiating it from classic medical arrest. This measure should apply to professionals in the private and public sector and to self-employed and self-employed agricultural workers.

Better protection against dismissal

The law inserts through the Labor Code a protection against dismissal for women facing a miscarriage: "No employer may terminate an employee's employment contract for 10 weeks following a medically confirmed spontaneous termination of pregnancy between the 14the and 21e week of amenorrhea included.' The employer may terminate the contract only if he can prove that the person concerned is guilty of grave misconduct or is unable to continue the contract on grounds foreigner to the spontaneous termination of pregnancy

Please note

the withdrawal of the waiting period must take effect by 1er january 2024. The route is scheduled to be set up from 1er september 2024.
