Maternity and paternity leave: the length of time required to obtain benefits is decreasing

The duration of social security membership required to receive the daily allowances related to maternity, paternity, childcare and adoption leave is now 6 months, compared to 10 months previously. This follows an order in council issued in Official Journal August 19, 2023.

Decree No 2023-790 reduces the registration time required as a social insured person in order to harmonize that time with Article 8 of Directive 2019/1158 of the European Parliament and of the Council on the work-life balance of parents and carers.

This change means that the minimum period of employment requested will be increased from 10 to 6 months.

The following are affected by the new deadline for obtaining daily social security benefits (IJSS):

  • insured persons whose date of commencement of maternity, paternity and child-care or adoption leave is after 20 August 2023;
  • women for whom maternity leave, due to a medical condition resulting from pregnancy or childbirth, has been increased by the duration of a medical condition and commenced on that basis alone before 19 August 2023.

The new 6-month period applies to employees, entertainment workers, agricultural self-employed and self-employed persons.

Reminder

Employees may receive daily social security benefits during their maternity, paternity or adoption leave provided that they meet various conditions (minimum period of membership to be respected but also number of hours worked, amount of contributions paid, etc.).

Unemployed persons are also entitled to these daily allowances if they meet certain criteria (receive an unemployment benefit or have ceased their employment for less than 12 months...).
