Hospitalization of the newborn: What is the impact on maternity leave?

If your child remains hospitalized beyond 6è week if you wish, you can interrupt part of your maternity leave postnatal (after delivery).

You can return to work before your due date and postpone the remaining days of your postnatal maternity leave until the end of your child's hospitalization.

So, by returning to your work after the compulsory 6-week postnatal leave, you will have:

  • 4 weeks postnatal leave (if it is your 1er or your 2e child, post-natal leave with a maximum duration of 10 weeks)
  • or 12 weeks postnatal leave (if it's your 3e child, post-natal leave with a maximum duration of 18 weeks)

You should then notify your CPAM: titleContent (or the MSA: titleContent if you are dependent on the agricultural plan) on the date of interruption of your maternity leave, the date of resumption of postnatal leave and the period of postponed postnatal leave.

You must send a certificate justifying the hospitalization of your child.

Postponement of part of the postnatal leave in case of hospitalization of your child beyond the 6th week depending on his birth cannot be denied you. You touch the daily allowances, under the usual conditions, upon resumption of your postnatal leave and throughout its duration.

You must also notify your employer of the date of your maternity leave interruption, the date of your return to the company and the length of postnatal leave being postponed.

You must send him a certificate justifying the hospitalization of your child.

FYI  

Your employer cannot refuse you postponement of part of the postnatal leave in case your child is hospitalized beyond 6th week after birth. Your salary will be paid in the usual manner during the resumption of your activity and throughout its duration.
