Can we get buried with our pet?

Publié le 15 novembre 2023 - Legal and Administrative Information Directorate (Prime Minister)

No, it's banned in France.

Even if you are strongly attached to your dog or cat, you cannot be buried with it. The burial in a communal cemetery is due solely to persons (Articles L2223-3 and L2223-13 CGCT). The mayor cannot allow the burial of an animal or its ashes.

The prohibition on burying one's pet is based on the concept of the dignity of the dead (Council of State, 17 April 1963, Blois). This notion implies strictly separating the spaces dedicated to the burial of humans and pets.

This is a question regularly put to the Minister of the Interior and Overseas Territories, because sometimes masters disregard the law and place the ashes of the animal on the funeral monument or at the time of beer production.

When questioned recently by a member of parliament about possible regulatory developments, the minister, in his response published on September 12, 2023, reminds us that the mayor must, as the law in force, prohibit the burial of an animal or its ashes in a communal cemetery.

So what do you do when your pet dies? Dog, cat, rabbit, horse, goat, pony... Service-Public-en reminds you of the rules: What to do when your pet dies?
