Future tenant of a private dwelling: supporting documents to give to the owner

What evidence can the owner (or his or her representative) claim from the prospective tenant and his or her guarantor to sign the housing lease? There is a list of permitted proof, and the owner is prohibited from requiring any more. The list of authorised documents is different, depending on whether it concerns the tenant or his security.

Please note

there is online service "Easy Folder (Tenant)" where the tenant can file the authorised documents and send them to the owner. The owner can create an account on "Easy Folder (Owner)" to encourage its future tenant to use this online service.

Tenant

The landlord is allowed to check certain information about the future tenant (identity, domicile, employment status, income). Only certain supporting documents are allowed.

FYI  

If the owner claims unauthorised proof, he or she is liable to a fine of up to €3,000 (or €15,000 in the case of a legal person).

The owner may require 1 valid ID of the following documents:

  • French or foreign identity card (with photo)
  • Foreigners or French passport (with photo)
  • French or foreigners driver's licence (with photo)
  • Temporary residence card
  • Resident Card
  • Member State of theEU: titleContent or EEA

The tenant can provide a copy of the original document. But the owner has the right to demand the presentation of the original. The document must be written or translated into French.

The owner may require only 1 proof of the following documents:

  • 3 last rent receipts or, if necessary, a certificate from the previous owner (or his agent) indicating that the tenant is up to date with his rents and charges
  • Certificate of the host's honour indicating that the applicant for the rental resides at his home
  • Proof of domicile
  • Last notice of property tax or, if necessary, title of the principal residence

The tenant can provide a copy of the original document. However, the owner has the right to require the presentation of the original. The document must be written or translated into French, the amounts entered must be converted into euros.

The owner may require 1 or more supporting documents of the following documents:

  • Employment or probationary contract or, if necessary, certification of the employer specifying the employment and the proposed remuneration, the date of entry into service envisaged and, if necessary, the duration of the trial period
  • Student card or certificate for the current year
  • Copy of professional card (professional)
  • Copy of the identification certificate of theInsee: titleContent with identification numbers (self-employed)
  • Original D1 extract from the register of trades under 3 months (craftsman)
  • Extract K or K bis from the register of trade and businesses under 3 months (commercial company)
  • Any recent evidence of professional activity (other cases)

The owner may require 1 or more documents of the following documents:

  • Last 3 pay slips
  • Proof of payment of probationary allowances
  • Last 2 balance sheets or, if necessary, attestation of the resources for the current financial year issued by an accountant (self-employed)
  • Justification for payment of allowances, pensions, social and family benefits and allowances received in the last 3 months or proof of entitlement established by the paying agency (pension fund, Caf: titleContent...)
  • Title of a property or last notice of a property tax
  • Scholarship Notice (Scholar Student)
  • Justification of land income, life annuities or income from securities and movable assets
  • Simulation certificate for housing aid established by the Caf: titleContent or MSA: titleContent or by the tenant
  • Last or last tax or non-tax notice.
    Where all or part of the income received has not been taxed in France, the last or second last equivalent document made by the tax administration of the State or territory concerned must be provided.

The tenant can provide a copy of the original document. But the owner has the right to demand the presentation of the original. The document must be written or translated into French.

Caution

The list of permitted parts is different depending on whether the deposit is a natural or legal person.

Legal entity (Action Housing, bank, company...)

Housing

When the future tenant has a security Housing, Action logement provides him with a Visa attesting that he benefits from Visal warranty. It is this Visa that the future tenant must provide to the owner of the dwelling.

Bank, company...

The owner may require the following 2 documents ::

  • Original excerpt K bis less than 3 months from the company or the articles of association or any other document justifying the legal existence of the legal person, mentioning the name of the person in charge and the address of the body and proof that a declaration has been made to a professional administration, court or body
  • Proof of identity of the representative of the legal person appearing on extract K bis or the statutes
