Visual Warranty: security for the tenant (unpaid and damages)

The Visale guarantee is a guarantee granted by Action logement to the tenant who wants to rent a house. The tenant must apply to Action logement. During the lease, if the tenant fails to pay the rent or the charges (or at the end of the lease the rental repairs), Housing Action pays the amounts due to the landlord (landlord). The accommodation is then refunded by the tenant.

The Visale guarantee covers the rents and unpaid expenses of the tenant:

  • within the limit of rent (including charges) of €1,500 in Paris and €1,300 on the rest of the territory (mainland and Dom)
  • up to 36 unpaid monthly payments

The Visale warranty covers rental damage, up to 2 months of rent and charges (only in case of private park accommodation).

This arrangement relieves the tenant from presenting any other deposit to the owner (lessor).

In case of unpaid payments or damage to property, Action logement reimburses the owner.

The lessee must then repay Housing Action all amounts paid on his behalf to the landlord.

The tenant reimburses Housing Action according to a schedule that can be adjusted to take account of its financial situation.

the Visale guarantee is a completely free service, for the tenant and the owner.

Tenant concerned

This device is for:

  • to any person aged 18 or over and until the eve of his or her 31e birthday (employee, civil servant, student, young in alternation, unemployed...)
  • to employees in the private sector (including the agricultural sector) who are over 30 years of age and have been employed for less than 6 months, with the exception of confirmed CDIs (i.e. have completed the trial period)
  • to private sector employees (agricultural or non-agricultural) earning up to €1,500 net per month
  • to employees in the private sector (agricultural or non-agricultural) who are in labour mobility
  • to a private sector employee (agricultural or non-agricultural) who has a promise of employment of less than 3 months
  • to the tenant of a rented accommodation with a mobility lease
  • to the tenant of a rented accommodation by a leasing agency, that is to say, whose lease is subscribed by an association that guarantees itself

Warning  

the tenant must not be a direct ascendant or descendant of the landlord, that is, grandfather or grandmother, father or mother, son or daughter.

Housing

The conditions vary depending on whether the accommodation is located in the province or in the Ile de France:

Province

Accommodation:

  • must be the principal residence of the tenant (unless the mobility lease)
  • can be an empty rented or furnished rented accommodation
  • must have rent (including charges) €1,300 maximum
  • must be decent and comply with the Departmental Health Regulations (DHSR)
  • must be the subject of a rental contract (housing lease, including mobility lease) including resolution clause
In the Ile de France

Accommodation:

  • must be the principal residence of the tenant (unless the mobility lease)
  • can be an empty rented or furnished rented accommodation
  • must have rent (including charges) €1,500 maximum
  • must be decent and comply with the Departmental Health Regulations (DHSR)
  • must be the subject of a rental contract (housing lease, including mobility lease) including resolution clause

The request must be made before signing the lease.

Housing Action Decision

Accommodation Action checks whether the tenant can obtain the Visale guarantee.

If yes, Housing Action sends him a visa after a few working days.

The visa is used to prove to the owner that the prospective tenant can obtain the Visale guarantee.

Visa delivery to owner

The tenant can download and print the visa from his personal account on the website Visale.

The tenant must hand it over to the future owner.

Indeed, the visa serves to prove to the owner that his future tenant can obtain the Visale guarantee.

Owner: application for bond

The owner must create his personal space on the Visale website :

A bond proposal is automatically generated.

Once completed, the tenant and the owner can sign the lease.

Owner Declaration

From 2 months of unpaid rent, consecutive or not, the owner must declare the unpaid to Action logement.

FYI  

when the tenant pays part of the rent, the landlord must report the unpaid amount to Housing Action as soon as he reaches the equivalent of 2 months rent.

To do this, the owner has to connect to his personal space on the Visale website .

the owner must respect reporting deadlines .

Refund by tenant

The tenant makes his payments by connecting to his personal space on the Visale website .

Through this space, the tenant can also request a schedule of his refunds.

Warning  

Housing Action may apply to the judge for the termination of the lease (i.e. the end of the lease) in the event that the tenant does not meet the schedule of its repayments.
