Guarantee Visale: deposit for the tenant (unpaid and degradations)

A future tenant (employee, civil servant, student, apprentice...) can ask Housing action to be his guarantor, that is to say to vouch for him. For this, he must ask Action Logement for the Visale guarantee. If the tenant fails to pay rent or charges during the lease, or rental repairs at the end of the lease, Housing action pays the amounts due to the owner (lessor). Housing action is then reimbursed by the tenant.
The conditions for obtaining the Visale guarantee vary depending on whether the accommodation is located in Île-de-France or not.
General case
The Visale warranty is a surety.
It exempts the tenant from presenting any other security to the landlord (lessor).
It is a totally free service, for the tenant and for the owner.
In the event of unpaid rent and unpaid charges, Housing action refunds the owner up to the equivalent of 36 monthly installments (over the entire term of the lease, even renewed, from the date of signature).
FYI
in the case of a 9-month lease to a student for a furnished accommodation of the social rental stock, the Visale guarantee covers the rent and unpaid charges of the tenant up to 9 monthly maximum.
The tenant must then refund Housing Action for all amounts paid on his behalf to the owner.
The tenant repays Housing Stock according to a schedule that can be adjusted to take into account his financial situation.

Tenant concerned
The Visale warranty is for the following people:
- Any person who is at least 18 years of age and until the day before his or her 31st birthdaye birthday (employee, civil servant, student, youth in alternation, unemployed...)
- Employee in the private sector (including the agricultural sector) over 30 years of age and employed for less than 6 months, except for confirmed CDIs (i.e. having completed the trial period)
- Private sector employee (agricultural or not) earning up to €1,500 net per month
- Employee in the private sector (agricultural or non-agricultural) in occupational mobility
- Private sector employee (agricultural or non-agricultural) with a promise of employment of less than 3 months
- Renter of a rented accommodation with a mobility lease
- Renter of a dwelling rented by a rental intermediary organization, i.e. whose lease is taken out by an association which guarantees itself
Warning
the tenant must not be a direct ascendant or descendant of the landlord, i.e. grandfather, grandmother, father or mother, son or daughter.

General case
The dwelling must be the principal residence of the tenant (unless mobility lease).
This can be an empty rented accommodation or furnished rented accommodation.
The housing must be decent and comply with the departmental health regulations (RSD).
The dwelling must be the subject of a rental contract (dwelling lease, including mobility lease) comprising a rescission clause.
Rent (including charges) must not exceed €1,300 and must not exceed half of the tenant's resources.
Student or apprentice (alternating)
The student or apprentice (alternating) must be at least 18 and less than 31 years of age. And he must be enrolled in a higher education institution for the current school year.
Rent (including charges) up to 600 €
The Visale guarantee is granted regardless of the resources of the tenant.
Rent (including charges) between €601 and €1,300
The Visale guarantee is granted if the resources per month of the tenant are greater than €1,200.
Rent (including charges) over €1,500
The Visale warranty is not granted.
1- Renter's online request
The request has to be made before the lease is signed.
To request the Visale guarantee, the future tenant must create his personal space on the site Visale.fr:

FYI
the tenant must scan or photograph multiple receipts.
2- Housing Action Decision
Housing action checks whether the tenant can obtain the Visale guarantee.
If yes, Housing Action sends him a visa after several working days.
The visa is used to prove to the landlord that the future tenant has the Visale guarantee.
3- The tenant gives the visa to the owner
The tenant can download and print the visa from his personal account on the site Visale.fr.
The tenant must hand it over to its future owner.
4- The owner requests a contract of guarantee
The owner must create his personal space on the Visale.fr website :
Owner: sign up for the Visale warranty
A proposal for a guarantee contract is automatically generated.
Once this is done, the tenant and the landlord can sign the lease.
Declaration by the owner
From 2 months of unpaid rent, consecutive or not, the landlord must declare the unpaid to Housing Action.
FYI
when the tenant pays part of the rent, the landlord must declare the unpaid to Action Lodging as soon as it reaches the equivalent of 2 months of rent.
To do this, the owner must connect to his personal space on the Visale.fr website.
Reimbursement by the tenant
The tenant makes his/her refunds by connecting to his/her personal space on the Visale.fr website.
Through this space, the tenant can also request a schedule of his refunds.
Warning
Housing Action can ask the judge to terminate the lease (i.e. the end of the lease) in the event that the tenant does not respect the schedule of his refunds.
The tenant may also apply for the following aid:
- Loca-pass advance (interest-free loan) to finance the security deposit
- Housing assistance (APL, ALF, ALS) to reduce the amount of rent
- Youth Mobility Aid to reduce the amount of rent
- Mobility aid (My job My accommodation) to facilitate the reconciliation of home/work or the entry into employment
Action Logement also offers the platform alternant.actionhousing, which lists the aids that the young person in alternation can benefit from:
