Hiring at the end of an internship: what impact on the probationary period?

If a trainee is hired in the company at the end of an internship carried out during his last year of study, the trainee hired may benefit from a reduction in his probationary period. The conditions vary according to the date of hiring, within 3 months after the end of the internship or more than 3 months after the end of the internship. 3 months after the end of the course

The length of the trial period reduction depends on the job for which the trainee was recruited.

Employment corresponding to the activities entrusted to the trainee

The duration of the internship is in full deducted from the duration of the trial period.

Example :

A former trainee is hired in the 3 months after the end of the course. If his employment contract provides for a trial period of 4 months, the duration of the training period is deducted in full from the duration of the trial period (which will then be 1 month).

Please note

When a trainee is hired by the company at the end of a traineeship that has lasted more than 2 months, the duration of that training period shall be taken into account for the purposes of opening and calculating entitlements relating to seniority.

Employment not corresponding to the activities entrusted to the trainee

The trainee may be hired on a position whose activities are different from those entrusted to him during the traineeship.

The duration of the course is deducted from the duration of the trial period but within the half the duration of the trial period.

Example :

A former trainee is hired in the 3 months after the end of the course. If his employment contract provides for a trial period of 4 months, the duration of the trial period is reduced but only by half (the trial period will then be 2 months).

Please note

When a trainee is hired by the company at the end of a traineeship that has lasted more than 2 months, the duration of that training period shall be taken into account for the purposes of opening and calculating entitlements relating to seniority.

More than 3 months after the end of the internship

The duration of this internship is not deducted the duration of the trial period.

However, treaty provisions more favorable conditions may apply.

Please note

When a trainee is hired by the company at the end of a traineeship that has lasted more than 2 months, the duration of that training period shall be taken into account for the purposes of opening and calculating entitlements relating to seniority.
