What can an individual employer do if an employee breaks an object?
Verified 04 August 2021 - Legal and Administrative Information Directorate (Prime Minister)
The individual employer is liable for damages caused by his employee at home.
If the employer considers that the employee's damages are due to a deliberate intention, it may punish the employee by warning, lay-off or dismissal. This will be the case, for example, when the employee voluntarily breaks a vase.
He cannot withhold the price of the broken item from the employee's salary, nor can he ask him to repay the item.
In addition to his insurance liability personal, the employer can take out professional indemnity insurance to guarantee the damage caused by his employee.
