Can a landlord rent an empty apartment for less than 3 years?

Yes, it is possible to sign a lease of less than 3 years when the following 2 conditions are met:

  • The lease is at least 1 year
  • A professional or family event justifies this exceptional duration. For example, the owner will take over the housing to live there after his retirement or to allow one of his children to continue his studies.

Warning  

The reason for the lease term must be stated in the lease.

During the lease, the landlord must inform the tenant of the upcoming realization of the event, by registered letter with acknowledgement of receipt, at least 2 months before the term of the lease.

If the event is delayed, the landlord may propose to postpone the lease term by registered letter with acknowledgement of receipt at least 2 months before the original lease term.

Only one postponement is possible.

FYI  

Where the event has not occurred or is not confirmed, the lease is considered to be a 3-year lease.
