Proxy voting: what should be done on voting day?

Did you get a power of attorney to vote in the general election? What formalities are to be known at the time of voting? And what happens if the power of attorney is not received? An instruction on the Interior Ministry’s proxy vote of December 31, 2021, says everything you need to know.

Voting operations

On the day of the vote, the elector holding a proxy (the agent) goes to the polling station where the person who gave the proxy (the principal) is registered.

At the entrance to the polling room, he presents his ID and possibly his voter card. The voter does not have to present the identification and voter identification card of the person for whom he or she is voting (principal). It simply indicates the name of the person for whom it will vote by proxy. Proxy voting will be indicated on the sign-in list.

The members of the bureau shall then verify that:

  • the person who has given power of attorney (principal) is clearly indicated on the sign-in list;
  • the person who has received power of attorney (agent) whose name is included on this list is the voter who is running to vote (verification of his identity document).

The proxy holder then receives an election envelope if he or she does not vote in that office or two envelopes if he or she also votes in that polling station. He takes the corresponding ballots and goes to the polling booth. He then goes to the polling table to put the election envelope or envelopes in the ballot box.

He/she shall sign on the sign-in list next to the name of the person who has given him/her power of attorney (the principal). If he votes in his name in the same office, he also stands next to his own name.

Please note

The proxy holder may not use the proxy that he holds if the elector who issued the proxy (the principal) has already voted personally. Indeed, on the day of the vote, the voter who instructed you to vote in his place can go to his polling station and vote personally, provided that he does so before you. He doesn't need to terminate the power of attorney.

Not receiving a power of attorney

Failure by the Mayor to receive the proxy prevents the proxy (the proxy) from participating in the poll. The presentation by the trustee of the receipt given to the principal cannot suffice.

If a power of attorney does not appear on the sign-in list (for example, in the case of late receipt after printing the sign-in list), the mayor enters on the list the name of the agent next to the name of the principal.

Since 1er in january 2022, the powers of attorney are no longer on the electoral list of the municipality.

The power of attorney shall be canceled in the event of the death or deprivation of the civil rights of the agent or principal.

Powers of attorney exceeding the authorized proxy limit are not registered and are not valid.

Apart from these two cases, there is no provision for the cancelation of powers of attorney by an administrative authority.
