Do you work in the public service and want to do something else in the public or private sector?

Is this cumulation allowed to you? And if so, under what conditions?

Don't panic, we'll explain!

As a public official, you must devote your entire professional activity to your public employment.

This is known as the "non-double-dipping" requirement.

However, some public or private activities are possible in parallel with your job. And provided you respect your obligations of professional discretion and secrecy.

There are three situations.

1st situation: activities that you can exercise freely.

This is the case, for example, for a voluntary activity with a public structure or an association or for an artistic activity.

2nd situation: the activities that you must report, i.e. which you must inform your administration.

This is particularly the case if you are employed on a non-full-time basis and do not work more than 24 hours 30 hours a week.

These activities can be carried out in the private sector and be remunerated, but always outside your working hours.

Another requirement: they must not place you in a conflict of interest situation. What does that mean? That there must be no interference between your personal interests and your missions within the public service.

3rd situation: activities which are subject to prior authorization by your administration.

These activities may be remunerated or unremunerated and carried out in a public or private structure.

For example, it could be a training activity, an agricultural activity or the sale of goods that you produce personally.

Again, it has to be consistent with your work schedule and not put you in a conflict of interest situation.

Finally, be aware that if you wish to start or resume a company, you must also ask your administration for permission to do so.

This is only possible if you are working part-time.

Before giving you its authorization, your administration examines in particular the compatibility of your project with your functions of the previous 3 years.

So we summarize in three key points?

  • In principle, job cumulation is not possible, but there are exceptions depending on the type of activity
  • There must be no conflict of interest with your missions in the public service
  • Only part-time agents can be authorized to create or resume a company.
