End of work stoppages with no waiting days and isolation of positive cases: what changes on February 1, 2023

Due to the improved health situation in France since the beginning of 2023, the rules in the face of the COVID-19 outbreak are changing. The derogating work stoppages, with no waiting day, for those tested positive shall be abolished as from 1er february 2023, according to a decree issued on january 28 in Official Journal. In addition, the Ministry of Health has announced that systematic isolation of COVID-19 positive individuals and testing of contact cases after two days is no longer required from 1er February. Service-Public.fr provides an update on all these changes.

End of sick leave Covid without day of deficiency

Employees who are positive to Covid-19 and who cannot telework will no longer be able to benefit from sick leave with compensation without checking the conditions for entitlement, without waiting period and without being counted in the maximum periods of payment from 1er February 2023.

Indeed, the derogatory system for the care of sick leave related to COVID-19 by the Health Insurance ends. From 1er in february 2023, you will no longer be able to request a derogatory work stoppage on the declare.ameli.fr online service.

The Health Insurance program is ending the “Contact Covid” service, which enabled the identification and care of people with Covid-19 and their contact cases. If your screening test is positive (RT-PCR or antigen test), you will no longer receive SMS or email from the Health Insurance. The ‘contact tracing’ of the Health Insurance to trace contacts in close contacts of Covid-19 positive persons is also abolished from 1er February 2023.

If you are infected with the COVID-19 virus and your health does not allow you to work, including working from home, you must make an appointment with your doctor who may prescribe a work stoppage.

Like any work stoppage, you have 48 hours to send the medical certificate to your health insurance fund and, if you are an employee, to your employer.

Set up at the start of the COVID-19 health crisis in 2020, this exceptional compensation scheme for work stoppages was extended several times. The Social Security Financing Act (SFSA) for 2023 published in the Official Journal of December 24, 2022, extended compensation to employees on Covid work stoppage without waiting days until a date set by decree, and no later than December 31, 2023. The decree of 27 January 2023 therefore sets the end date of the scheme at 1er February 2023.

End of routine isolation of positive cases and testing of contact cases

In line with the recommendations of the High Council on Public Health (HCSP), from 1er February 2023, people who tested positive for COVID-19 are no longer required to self-isolate.

People without symptoms who have been in contact with people who have tested positive for Covid should no longer be required to test 2 days after being notified.

However, COVID-19 positive individuals and those who have been in contact with a contagious person are still strongly advised to:

  • respect barrier gestures (wearing a mask, physical distancing, hand hygiene...);
  • do a screening test;
  • avoid contact with the frail.

The online service " List my contacts” allowing Covid-19 positive individuals to easily list people they had contact with before their Covid-19 infection will also be removed from 1er February 2023. Thanks to this online service, the health insurance could quickly and directly send the right health instructions adapted to their situation to the persons identified.

The “contact tracing” carried out by the Health Insurance ends on the 1er February 2023.

Evolution of the SI-DEP tool

From 1er February 2023, people who perform a test at a laboratory, pharmacy or testing center will be required to provide prior consent for the test results to be recorded in the SI-DEP tool. You will be able to accept or refuse the sharing of your test data. The SI-DEP tool will remain in operation until 30 June 2023.
