Delay on your 2023 tax return: What penalty do you incur?

You're late to report your income

The tax return must be made according to the current year calendar. If you file outside the stated time limits, you risk an increase in your tax, defined as follows:

  • 10% if you take the steps before the formal notice is given;
  • 20% where the declaration has been lodged within 30 days of receipt of the formal notice;
  • 40% where the declaration has not been lodged within 30 days of receipt of the formal notice;
  • 80% if the tax administration discovers that you are engaged in a covert activity (undeclared work or illegal activity); in this case, you do not receive a prior notice.

are you experiencing financial difficulties in paying your taxes? Report it to the tax authority who can give you extra time to pay depending on your situation. A partial or total remission of the tax or penalties applied may be granted in certain cases. A valid reason such as hospitalization exonerates you from penalties.

You pay your taxes outside the time limits

The following shall be considered as late payment:

  • default of payment;
  • partial payment;
  • late payment.

Late payment results in a penalty of 10 % of the tax due.

This penalty applies if you have not paid your tax within 45 days which follow the date of assessment. It shall also apply in the following situations:

  • late payments on account which have not been paid on the 15th of the following month (in which they became due);
  • delay in payment of due dates, in the case of monthly direct debit. In this case, at the second delay, you also lose the option of opting for the monthly levy.

What is interest on late payment?

In addition to these penalties, interest is charged on late payment. They amount to 0.20% of tax due per month (2.4% of the tax due if you have not declared anything after one year).

Warning  

if you are affected by a paper return, you must send it by May 22 at 11:59 pm, regardless of where you live (including French people living abroad). The postmark is authentic.
