Public officials: parental and caregiving leave is changing

Public officials can now apply for compassionate care leave to be with a person whose disability or loss of independence requires regular assistance, so there is no longer a need for the person’s health to be “particularly serious” as was previously specified. They are also now allowed to split their parental or caregiving leave into half days rather than full days.

A decree issued in Official Journal on 27 august 2023, a number of provisions concerning parental and caregiving leave in the public service were relaxed, both for incumbent and intern civil servants and for contractors.

Reminder

compassionate care leave allows people to temporarily stop working or to work part-time to care for a disabled or disabled relative.

Parental attendance leave, on the other hand, allows a child to reduce or stop working in order to care for a dependent child who is sick, injured or disabled, and who needs binding care and a sustained presence from one or other of his or her parents.

Parental and caregiving leave is not paid, but it is possible to receive a daily allowance from the Family Allowance Fund.

Arrangements for renewing parental leave

The decree also specifies the conditions for the renewal of parental leave "exceptionally"; its initial duration is set at 310 working days over a period of 36 months (3 years) for the same child and the same pathology.

If a public official has exhausted the 310 days of leave before the end of the 36-month period, his leave may be renewed once for the same illness, disability or accident for a maximum of 310 working days during a further 3-year period. In order to be eligible for this renewal, the staff member must present a new medical certificate drawn up by the doctor following his child, indicating the continuation of compulsory care and the need for one or other of the parents to be present alongside the child.

In case of a new pathology, a new leave of 310 days may be granted, without waiting for the end of the 36 months.

Please note

the duration of the care-giving leave is fixed at a maximum of three months, renewable within one year over his entire professional career. It can be taken in several ways:

  • in a continuous period;
  • divided into periods of at least half a day;
  • in the form of part-time service.

Caregiver leave may be requested, in particular, to care for a Civil partnership, partner or partner, parents, grandparents and children in care; but also to care for an elderly or disabled person with whom one resides or has close and stable ties and to whom one regularly and frequently assists in a non-professional capacity.
