Winter truce: November 1, 2023 to March 31, 2024

The winter truce is the period during which eviction proceedings for a tenant who does not pay rent are suspended. It's fixed from 1er November 2023 to March 31, 2024. However, the winter truce does not apply in certain situations.

Winter truce suspended on Wednesday 1er november 2023 to sunday, march 31, 2024, the eviction of a tenant, notably due to successive unpaid bills. However, some people are not protected by the winter truce:

  • persons receiving rehousing commensurate with their family needs;
  • squatters occupying a home, whether a primary or secondary residence;
  • squatters occupying a garage or land. In this case, the judge ordering the expulsion may decide to abolish the winter truce or to shorten its duration;
  • the spouse whose expulsion from the matrimonial home was ordered by the family court as part of the non-conciliation order in divorce proceedings;
  • the abusive spouse, partner of Civil partnerships or cohabiting partner in the relationship or on a child whose expulsion from the family home has been ordered by the family court as part of a protection order.

At the end of the truce, and if the problem has not been resolved, the rental eviction procedure can be resumed and executed by a bailiff.

Please note

it is the Alur law of March 2014 that sets the dates of the winter truce: of 1er November to March 31. In certain circumstances, and in particular during a health crisis, the government may decide to extend this period or to take exceptional measures after the truce has ended.

Reminder

the principle of the winter truce has been extended to cover electricity and gas outages, which are now prohibited during this period.
