Rents blocked from August 24, 2022 for thermal sieves

From 24 August 2022, the rents of dwellings with an energy performance diagnosis classified as F or G (

energy strainers

or

thermal

) can no longer be increased. This freeze applies to new leases and, progressively, to existing ones, on the basis of their tacit renewal or renewal.

Pursuant to the Law on Combating Climate Change published in Official Journal of 24 August 2021, the rents of dwellings with an energy performance diagnostic (EPD) classification of F or G (

heat strainers

) will not be subject to any increase. This provision was scheduled to come into force one year after the Act was published in Canada. Official Journal.

This block applies to naked or furnished rented accommodation. It applies to new contracts as well as to contracts in progress, renewed or tacitly renewed. Indexation to the benchmark rent index will not be available on the anniversary date of the lease. Any renovation work will not allow for an increase, unless it changes the EPD classification.

FYI  

the energy performance diagnosis (EPD) must be given to the tenant at the time of the conclusion of the lease. It must have been done for less than 10 years.

The ECD criteria have been revised and those that were completed before December 31, 2017 will need to be renewed before December 31, 2022; those that were completed before June 30, 2021 will need to be renewed before December 31, 2024.
