If you are a foreigner without nationality, you can apply for stateless status at the French Office for the Protection of Refugees and Stateless Persons (Ofpra). If your application is accepted, you will receive a residence card. In case of refusal, you can appeal to the administrative judge.

Stateless person status refers only to the person to whom no country grants nationality.

Statelessness can be the result of one of the following situations:

  • Contradictions between several nationality laws
  • Absence or failure of civil registration in some countries
  • Transfers of sovereignty
  • Due nationality
  • Strict application of blood and soil law in some countries

Application Filing

You must make your written request in French atOfpra, including your name(s), first name(s) and address and the reasons for your request.

Ofpra saves it and sends you a registration form and certificate.

You must return this completed and signed form to Ofpra by registered letter with acknowledgement of receipt and include:

  • 2 recent identity photos
  • Your passport, documents relating to your marital status, a copy of your valid residence document (if you have these documents)

Application review

You can be called for an interview atOfpra.

You are then heard in the language of your choice.

Ofpra may authorise you to present yourself with either a lawyer or a representative of an association.

Ofpra can also collect information from the consular offices of the various countries of which you may be a national.

Recognition as stateless

If you are found stateless, you are placed under the administrative and legal protection of theOfpra.

The Ofpra issues you civil registration documents (birth, marriage, etc.) if he cannot obtain them from the country where the events of his life took place.

  FYI : no decision on a stateless person's application can come about because of Ofpra's silence.

You must submit your card application to the prefecture (or sub-prefecture) of your home (find out about it on the prefecture website).

The multi-year residence card stateless person allows you to stay in France.

Family members can enjoy the same card:

  • Your spouse, partner or common-law partner, who is already allowed to stay in France under family reunification
  • Your spouse or partner of civil union, at least 18 years of age, provided that the marriage or civil union is earlier than the date of your application for asylum
  • Your partner, at least 18 years of age, with whom you had a sufficiently stable and continuous common life before the date of your application for asylum
  • Your children within one year of their 18th birthday or between the ages of 16 and 18 who say they want to work
  • Your parents (direct ascendants to 1to degree) if you are a refugee child and you are still a minor and unmarried

  Please note : the card issued to your family members is marked family member of a beneficiary of stateless status.

Documents to be provided

Stateless

Parts to supply:

  • Ofpra decision granting you stateless status
  • Civil status certificate (forwarded by Ofpra to the prefecture)
  • 3 photos. If the request is made online: enter the code of the e-photo (provided by the photographer or the approved cabin on the photo board).
  • Declaration on the honour of non-polygamy in France if you are married and are a national of a country that allows it

If your file is complete, you receive a reclaimed pending the prefecture's response.

Stateless family

  • Full copy of birth certificate (unless you already have a residence card) with the latest information
  • Passport (pages on marital status, validity dates, entry stamps and visas). Otherwise, other supporting documents (for example: Consular certificate, identity card, consular card).
  • Ofpra decision granting stateless persons
  • 3 photos. If the request is made online: enter the code of the e-photo (provided by the photographer or the approved cabin on the photo board).
  • Declaration on the honour of non-polygamy in France if you are married and are a national of a country that allows it
  • Justification of the family link with statelessness: proof of marriage (full copy of the marriage certificate or family record) or proof of parentage for children (full copy of the birth certificate or family record for legitimate children, declaration made by the stateless person to the civil registrar acknowledging his paternity or natural maternity for natural children, adoption decision for adopted children)
  • If you arrived in France under family reunification: medical certificate issued by theOfii (at the latest at the time the title is handed over)

If your file is complete, you receive a reclaimed pending the prefecture's response.

Cost

You must pay €25 (stamp duty) by tax stamps.

The proof of payment of the stamp duty is required upon delivery of the card.

Card Delivery

The card is given to you by the prefecture (or sub-prefecture) of your home.

Term

The residence card is valid 4 years.

Renewal

After 4 years of stay in France with the card stateless person, you can request resident card, within 2 months of the date of expiry of your residence card.

Appeal

  Reminder : the National Court of the Right to Asylum (CNDA) does not have jurisdiction over applications for statelessness.

If your application for stateless person status is refused by Ofpra, you can challenge the decision in the administrative court of your place of residence.

This appeal must be lodged within 2 months of notification of the refusal.

  Warning : the litigation is not suspensive, that is, you can be subject to a obligation to leave France (OQTF) and be removed before the judge has made a decision.

The multi-year residence card stateless person and the resident card allows you to work in France.

You can practice the profession of your choice (as an employee or self-employed).

You therefore do not need express permission to work and employment situation is not opposable.

If you wish to travel to the foreigner, you can apply for a biometric stateless travel document.

You have a multi-year residence card

The biometric travel document is valid 4 years and €40.

You have a resident card

The biometric travel document is valid 5 years and €45.

Statelessness ceases if you acquire a nationality or reintegrate your original nationality.
