Interim residence permit (APS) for a parent foreigner of a sick child

If you are a foreigner (except European), living with your minor child in France and the latter is seriously ill, you can obtain a provisional residence permit (APS), subject to conditions.

You can obtain a Temporary Residence Permit (SPA) for care to accompany your sick minor child if all of the following conditions are met:

  • Your child's health requires medical care in France
  • Your child cannot have access to the appropriate treatment in your country of origin
  • You usually reside with your child in France and support their maintenance and upbringing
  • You don't represent a threat to public order

Medical record

You must take a file to the prefecture of your home.

The file includes a medical certificate to be completed by your regular doctor (or hospital practitioner) and an envelope medical confidentiality with the address of the medical service of theOfii: titleContent.

The complete file to be sent to the Office shall include the following documents:

  • Medical certificate providing the most complete information possible to allow the investigation of your file as soon as possible, dated, signed, with the stamp of the doctor
  • Originals of all documents on the declared health situation (laboratory tests, additional examinations, report(s) of hospitalization(s), etc.)

The Ofii doctor examining the file may request additional medical information from the doctor who issued the medical certificate. You'll be informed. Such additional information must be received within 15 days of the date of the request.

The Ofii doctor may summon your child for a medical examination if he or she deems it necessary. The exam is free of charge. You will need to show proof of identity. They may also ask for additional tests. You don't have to pay. The results of these examinations must be communicated within 15 days of the date of their request.

If you do not respond to the requests of the Ofii doctor, you will not be able to obtain receipt for application for a residence permit.

The medical report is sent to a medical college of Ofii, which gives its opinion to the prefect of your place of residence. The Ofii College of Doctors can summon you and your child (you can be accompanied by a doctor of your choice and an interpreter, you will need to show proof of identity). The college of physicians may arrange for additional examinations.

Temporary residence permit (APS)

The decision concerning your application for a provisional residence permit shall be taken, after this opinion, by the Prefect. It will be for you notified by the prefecture.

In case of a favorable decision, you can request a provisional residence permit at the prefecture.

Documents to be supplied:

  • Full copy of birth certificate (unless you already have a residence card) with the most recent entries
  • Passport (pages concerning civil status, validity dates, entry stamps and visas). Otherwise, other supporting documents (e.g. consular certificate, identity card, consular card).
  • 3 photos. If the request is made on the internet: enter the code of the e-photo (provided by the photographer or the approved cabin on the photo board).
  • Proof of your habitual residence in France with your child: visa, receipt of application for a residence permit, receipt of application for asylum, passport of the child, bank statements presenting movements, indisputable personal writings (letters, certificates of relatives), etc.
  • Civil status documents establishing the relationship of filiation with your child or judgment which conferred on you the exercise of parental authority
  • Proof of support for the maintenance and upbringing of your child: habitual residence and common residence with the child, payment of all costs related to the minor (maintenance, tuition, care, etc.)
  • Proof of payment of the visa fee for regularization (to be submitted at the time of delivery of the certificate)

The APS is given to you by your prefecture. It is free and allows you to work in France.

Warning  

no medical information or medical certificate must be communicated or given to the prefecture.

The temporary residence permit is valid 6 months.

If your child’s treatment duration so requires, you can request renewal of your PSA (within 2 months of its expiry date).
