Voluntary severance pay in EPF

The official or the contractor in question DTA: titleContent whose post is being restructured and who resigns may be entitled, under certain conditions, to a voluntary severance pay.

You can receive a voluntary severance payment if your position is being restructured and if you choose to resign as a result.

You can also receive a voluntary severance pay if you choose to resign if your position is deleted as part of a service restructuring.

If you wish to receive the voluntary severance pay, you must apply for it and get a positive response from the administration before submitting your resignation.

The services, units, grades or posts affected by a restructuring, for which the allowance may be awarded, and the period during which it may be granted, shall be fixed by ministerial decree.

Voluntary severance pay may be granted to you whether you are a civil servant or a member of the contract staff DTA: titleContent.

You must be more than 2 years from the minimum retirement age on the date on which your request for resignation is sent, the postmark being authentic.

If you have signed a commitment to serve the government after a period of training, you must have completed the full period of service provided by that commitment.

The amount of the allowance is equal to 1/12e your annual gross remuneration, multiplied by your full years of actual service in the administration, up to a maximum of 24 times 1/12e.

The gross annual remuneration taken into account is that received in the year preceding that of your request for resignation.

If you are on leave, on parental leave or on unpaid leave, the gross annual remuneration taken into account is that received during the last 12 paid months.

Example :

for staff with 15 years' service and annual gross remuneration of €25,000, the voluntary severance pay shall be €31,250 (25,000 / 12 x 15)

Bonuses and allowances granted on an ad hoc basis shall not be taken into account for the purposes of determining annual gross remuneration:

The voluntary severance pay is paid in one installment once the resignation has become effective.

At your request, it can be paid in 2 installments over 2 consecutive years.

If you are re-recruited as a public servant or contract employee within 5 years of your resignation, you must pay back your voluntary severance pay.

This applies whether you are recruited into the state, territorial or hospital public service.

Reimbursement must be made within 3 years of your recruitment.

You can collect unemployment benefits if you meet the conditions to take advantage of it.
