Professional Security Allowance (ASP)

In case of dismissal on economic grounds, where the employee accept the professional security contract (CSP), France Travail (formerly Pôle emploi) paid him a financial assistance called occupational security allowance (ASP).

How is this allowance calculated? When is it paid? For how long? We're doing an update on the regulations.

Warning  

The rules differ according to seniority of the employee at the time of rupture.

Seniority is calculated:

  • On the date of submission of the letter of notification of the dismissal, where it is notified before the end of the 21-day reflection period left to the employee to accept or refuse the dismissal. CSP
  • On the last day of the 21-day cooling-off period, where the letter of dismissal has not yet been notified

1 year of service or more

Please note

The amount of such allowance shall be at least equal to the amount of Return-to-Work Allowance (RWA) which the employee would have received in the event of dismissal without CSP.

The occupational security allowance is paid each month, in due course, to the beneficiary who has updated his situation with France Travail (formerly Pôle emploi).

The occupational security allowance is payable the day after the end of the employment contract.

There is no deferred compensation, or waiting period.

Please note

In the event of accession to the CSP on a proposal from the France Travail (formerly Pôle emploi) adviser, the payment of the ESL shall start as from the day following the end of the 21-day reflection period.

The occupational security allowance shall be paid for a period of 12 months from the entry into force of the professional security contract (CSP), irrespective of the period of membership which the beneficiary of the CSP justifies.

No, the payment of the occupational security allowance is not degressive.

Yes, the ESL payment is interrupted in the following cases:

  • Resumption of an employed activity in the form of a fixed-term employment contract or a temporary employment contract of at least 3 days and less than 6 months in France or abroad
  • Social security coverage of the beneficiary of the ESL and daily allowances (e.g. in case of illness or accident)
  • Beneficiary no longer residing in metropolis, the overseas departments (with the exception of Mayotte), Saint Pierre and Miquelon, Saint Barthélemy and Saint Martin
  • Lack of update by the beneficiary of its monthly situation

The payment is interrupted for the duration of the event.

The payment of the ESL cease permanently in the following cases:

  • Resumption of an employed activity in the form of an employment contract of indefinite duration, a fixed-term contract or a temporary employment contract of less than 3 days or of at least 6 months
  • Cases of termination of the CPMP benefit (refusal of reclassification or training action, for example)
  • Creating or Resuming company
  • Final departure of the beneficiary of the SPA abroad
  • Resumption of self-employed professional activity in France or abroad
  • Full Retirement Age Achieved by PSO Recipient
  • Early retirement taken by the beneficiary of the ESL

Yeah. Yeah. The occupational security allowance is only subject to the supplementary pension contribution.

Yes, the occupational security allowance is subject to income tax.

If, at the end of the job security contract, the employee is still looking for a job, he can receive unemployment benefit and return-to-work assistance (ARE).

The RCA is paid without deferred compensation, or waiting time.

The duration of the compensation shall be reduced by the number of days during which the employee received the occupational security allowance.
