Your situation

  • Your credit card information has been used without your consent
  • You still have your credit card
  • The fraud was committed on the Internet

You are the victim of a credit card fraud if you gather all of the following conditions :

  • Your credit card details have been used to make online purchases
  • You have not made the purchase (nor is it the purchase of another usual user of the card)
  • The credit card is still in your possession

Generally, you are warned of fraud in the following cases:

  • You notice online purchases on your bank statement that you did not make
  • You have received a confirmation code on your phone for a purchase you did not make
  • You have been notified by your bank of an attempt to fraudulently use your credit card on the Internet

You must oppose, which means blocking the use of your card.

To do this, contact your bank or call the Opposition Interbank Server.

Who shall I contact

A registration number is provided.

You have a dated record of your objection.

If your credit card agreement requires it, you must notify your agency of your objection by registered letter with acknowledgement of receipt or on the spot, at the counter. This is not necessary if you have contacted your bank to object.

Opposition proceedings may be paid for. Its cost varies depending on the banks and any insurance guarantees taken to cover the risk.

It is advisable to report fraud to the police.

For this, you can make a report (online) or file a complaint (on-site or by mail).

  • The alert is to inform the investigation services of the existence of fraud. You can remain anonymous. You will not be informed of the outcome of the case.
  • The complaint is the act by which the victim of a fraud informs the judicial authority.
    When you file a complaint, you must give your identity. This approach is binding on you and investigators can contact you.

A report, like a complaint, allows you to obtain a receipt, a document attesting to the registration of your return. You can send the receipt to your bank when you request a refund.

Report fraud (online)

Before starting the online approach, also called Perceval, prepare the information you need:

  • Your objection number
  • Your credit card number
  • Your bank statements

Once you have logged in to the online process, provide information on fraudulent purchases made.

Your application will be processed by the National Gendarmerie and you will receive an email within a few hours acknowledging receipt of the declaration.

If you have an account on service-public.fr, the receipt will also be available in the “my documents” section of your personal space.

File a complaint (on site)

You must go to a police station or the gendarmerie of your choice.

Who shall I contact

The police or gendarmerie services are obliged to register the complaint.

The complaint is then forwarded to the public prosecutor for a decision on further action (investigation, closure without further action...).

If you don't know the perpetrator, you can fill out an online pre-complaint before traveling.

You will then get an appointment and the police or gendarmes will already have the elements of your complaint upon your arrival.

File a complaint (by post)

You can file a complaint with the public prosecutor.

We need to send a free-form letter the court of law of the place of the offense or of the domicile of the offender.

Who shall I contact

The letter should specify the following:

  • Your marital status and full contact information (address and telephone number)
  • Detailed account of the facts, date and place of the offense
  • Name of the alleged perpetrator if known (otherwise, the complaint will be filed against X)
  • Names and addresses of any witnesses to the offense
  • Description and provisional or definitive estimate of the damage
  • Evidence: medical certificates, work stoppages, miscellaneous invoices, findings ...
  • Willingness to take civil action

You can send your complaint by registered letter with acknowledgement of receipt, by simple letter or by letter followed.

You can also file your complaint directly at the courthouse.

In any case, a receipt is given to you as soon as the Public Prosecutor's Office has registered your complaint.

Procedure

You must request a refund of the debited amount from your bank. Check with your bank to find out how to apply.

If you have reported online fraud to law enforcement, you must send the receipt to your bank.

The bank must refund all debited amounts. They must also reimburse you for any action, i.e. the costs of any payment incident.

If you have opposition belatedly, your bank may refuse to reimburse you. A fraudulent payment cannot be refunded if it is more than 13 months old. If this payment is made outside theEuropean Economic Area, the repayment period shall be 70 days.

Appeals

If you have a dispute about a refund, you can enter the banking ombudsman.

If the intervention of the banking ombudsman did not put an end to the dispute, you can take the case to court.

The competent court depends on the sums involved in the dispute.

  • For a case less than or equal to €10,000, it is the local court or the judicial court.
  • For a case greater than €10,000No, it's the court.
