An apprentice can now complete part of his or her practical or theoretical training in a country bordering France.

That's what the law no. 2022-217 of 21 february 2022.

Ordinance No. 2022-1067 of 22 December 2022 lays down the arrangements for organizing, implementing and financing cross-border learning.

Future decrees must determine the conditions of application of this ordinance.

The two contracts alternate theoretical training in an educational institution and practical training in company.

The apprenticeship contract is the responsibility of the initial training whereas the contract for professionalization falls under the continuing training.

The main differences are in the types and duration of the contract, the age and the remuneration of the beneficiary.

Duration of contract

Where the contract is of limited duration, its duration shall be Minimum 6 months to a maximum of 3 years.

The maximum duration of the contract may be increased to 4 years where the apprentice is a handicapped worker.

The duration of the contract shall be specified in an agreement annexed to the contract.

If it is a CDD, the minimum duration is between 6 and 12 months.

It may be lengthened in some situations.

Age

  • From 16 to 29 years (30 years minus 1 day)
  • 15-year-old under conditions
  • The maximum age may be increased to 34 years (35 years minus 1 day) in the following cases:

  • The apprentice wants to sign a new contract to access a higher level of diploma than that already obtained
  • The previous contract was broken for reasons beyond his control, or for physical incapacity.
  • It should not take more than 1 year between the 2 contracts.

    There's no pitchage limit if the apprentice is in one of the following situations:

  • He's recognized handicapped worker
  • It plans to set up or take over a company involving the completion of a diploma (e.g. individualized aid scheme) Acre, Mother-of-Pearl or Cape)
  • He is a high-level athlete or he does not obtain the relevant diploma or professional title (maximum extension of 1 year)
  • From 16 to 25 years of age (26 years less a day) to complete initial training
  • 26 years and older for jobseekers
  • No age requirement for beneficiaries of the RSA: titleContent, of theSSA: titleContent or theAAH: titleContent and for persons leaving a single insertion contract (CUI)

Training

At a minimum 25% of the total duration of the contract

150 hours minimum and between 15% and 25% of the total duration of the contract

Remuneration

Enter 27% and 100% of the Smic: titleContent depending on age and level of education, or the conventional minimum wage if more favorable

Enter 55% and 100% of the Smic: titleContent according to age and level of education, or 85% the minimum remuneration provided for by the collective agreement or the company branch agreement if more favorable
