Post-parking package in case of unpaid parking

The post-parking package (FPS) replaces the fine of €17 in the case of unpaid or insufficiently paid parking. The amount of FPS: titleContent varies from one commune to another. It is to be paid within 3 months. The amount can be reduced if you pay quickly. The amount is increased if you pay late. You can challenge the SGF through a mandatory prior administrative appeal (Rapo). If the Rapo is not successful, you can refer the matter to the Commission du contentieux du parking payant (CCSP).

The FPS: titleContent applies in an area where parking is charged.

It concerns the following 2 situations:

  • You park your vehicle without paying
  • You're over the time you paid

However, you do not have to pay the SGF if you paid your parking fee and provide proof of it or if you have a free parking permit.

Example :

You have mobility card inclusion marked parking for disabled people or a valid parking card for a disabled person.

different rules apply in the event of dangerous or inconvenient parking..

The FPS: titleContent you notified by notice of payment.

The notice of payment can be notified in 3 ways:

  • Deposit on the windscreen of the vehicle
  • Mail to the gray card holder
  • Email to the gray card holder

The notice of payment of FPS: titleContent includes the following information:

  • Community and service provider controlling paid parking
  • Date and time of report
  • Parking finding address
  • Vehicle registration number
  • Amount of SGF to be paid, reduced if necessary by amounts already paid before the check
  • FPS End Time
  • Service to which the SPF is to be paid
  • Possibility of reduced SPF
  • Means of payment and settlement deadline
  • Remedies and deadlines

The amount of FPS: titleContent varies from one commune to another.

The FPS: titleContent also varies according to the parking areas of the same municipality.

The price can be adjusted according to several criteria: duration of parking, surface occupied by the vehicle, impact of the vehicle on pollution...

The rate may be reduced depending on the level of income of users, their status or the number of people living in their homes.

Example :

The tariff may provide for a fixed-term free range and specific pricing for certain categories of users, including residents.

The FPS: titleContent may not be more than the amount of the charge due for the maximum authorized parking period in the area where you have parked your vehicle.

Example :

Where parking is limited to 1 hour, the amount of the SPF may not exceed the amount due for 1 hour of parking.

You did not pay for parking

You must pay the amount of FPS: titleContent fixed by the municipality.

You've exceeded your paid time

The FPS: titleContent is reduced by the amount already paid.

However, the following 2 conditions must be met:

  • The proof of the sum already paid must be placed in the front of the vehicle or must have been transmitted by dematerialized means
  • The parked vehicle shall not have exceeded the maximum authorized parking time in the area concerned

There are several payment deadlines.

Quick payment (5 days at +)

In some communes, if you pay quickly, the amount of the SPF is underrated..

For example, if you pay within 5 days.

Check the payment notice received or deposited on your vehicle to find out when and how to pay.

Payment within 3 months

You must pay FPS: titleContent within 3 months from notification the notice of payment.

The payment deadline is indicated on the payment notice.

Payment after 3 months

If you exceed the 3 month period, the amount of FPS: titleContent shall be increased by at least €50..

One enforceable title is issued and you receive a warning.

  • In the event of voluntary payment of the enforceable document within 1 month of the sending of the warning, the amount of the mark-up shall be reduced by 20 %.
  • If you do not pay within 1 month, the administration can implement actions in recovery.. You risk prosecution of your property, bank accounts, wages, vehicles...

if you have financial difficulties, you can apply for graceful discount the municipality or the Treasury. The contact details are indicated on the payment notice. If your application is refused, contact the Commission du contentieux du parking payant (CCSP).

If you go to another public finance center, only payment by credit card is possible.

Step 1: prior administrative appeal

If challenge the FPS: titleContent, you must file compulsory prior administrative appeal (Rapo)..

You have 1 month following notification SPF to do the Rapo.

Consult the SPF payment notice to find out who to send your Rapo (commune, mixed union...) and how (registered letter with AR: titleContent or electronically).

You must attach the following documents to your appeal:

  • Copy of the disputed payment notice
  • Copy of the gray card of the vehicle (now called certificate of registration)
  • If necessary, copies of the declaration of transfer of the vehicle and the acknowledgement of registration of your application for registration certificate
  • Statement of facts and evidence justifying the appeal. For example, copy of the parking ticket, copy of a resident subscription, copy of an inclusive mobility card, photos, complaint.

Your appeal must be examined within one month of receipt. The date shall be indicated on the acknowledgement.

  • If your appeal is accepted, the notice of payment is canceled. You will receive a corrective payment notice to €0 (refund of paid PSF).
  • If your appeal is refused in whole or in part, or if no reply is received within the 1 month period, you may refer the matter to the Commission du contentieux du parking payant (CCSP).

Please note

the Rapo does not interrupt the payment period of the SGF. After 3 months, the absence of payment results in an increase.

Step 4: referral to the Parking Litigation Commission

In the event of a refusal or an unsatisfactory response to your Rapo, you may refer the matter to the Commission du contentiant du parking payant (CCSP).

In order for your application to be considered, you must submit your application to the CPSC within 1 month of the notification Rapo's decision.

Be careful to fill out the exact part 4 of the "Statement of Fact and Law" form.

Application to the Commission du contentié du parking payant (CCSP)

Attach the following 4 documents to the form:

  • Copy of the payment notice FPS: titleContent contested
  • Copy of your Rapo (protest letter or form addressed to the municipality or its service provider)
  • Copy of the postal or electronic acknowledgement of receipt of the Rapo
  • Copy of the decision of the municipality or company which established the SGF following your appeal

if you dispute several FPS: titleContent, you must send a file per contested FPS. Otherwise, the CPSC only takes into account the 1to FPS contested.

If you wish to challenge the increased PSF, you can refer the matter directly to the Commission du contentié du parking payant (CCCS).

In order for your application to be considered, you must submit your application to the CPSC within 1 month of the notification of the warning.
