Pension reform: update on first decrees

The first two decrees implementing the pension reform were published on 4 June in the Official Journal. They concern in particular the conditions under which the retirement age is postponed. The entry into force of these provisions is provided for in point 1er September 2023. Service-Public.fr provides information on the elements of these orders.

These first two decrees (2023-435 and 2023-436), among the 31 planned for the reform, set out the detailed rules for the application of Articles 10, 11 and 17 of the Law on the Amending Financing of Social Security for 2023. They're relative

on the one hand, the gradual increase in the pensionable age from 62 to 64 and the acceleration in the rate of increase in the period of insurance required for the full rate, and on the other hand, early departures, in particular in the case of long careers and on grounds of disability

, says the government.

Raising the age of pension entitlement

For insured persons subject to the common rule, the age is currently 62. It is increased to 62 years and 3 months for persons born between 1er September 1961 and December 31, 1961, and must increase by one quarter per year of birth, i.e. 64 years for persons born from 1er january 1968.

The deferral also concerns persons benefiting from exemptions. Civil servants engaged in arduous or dangerous occupations falling within the categories

super-active

and

active

the minimum age of which will be increased to:

  • 52 to 54 years of age for the first category (police officers, sewers, prison staff, etc.);
  • 57 to 59 years for the second category (nursing assistants, etc.).

Long Careers

The decrees also concern the recasting of the provisions of the

long quarries

which allows people who have started working young to leave earlier. The reform provides for 4 pensionable ages, as opposed to 2 today (provided you have contributed a sufficient number of quarters)

  • 58 if you started working at 16;
  • 60 years if you started working at 18;
  • 62 if you started working at 20;
  • 63 if you started working at 21.

Please note

one

safeguard clause

allows policyholders who are currently eligible for early retirement for long careers to postpone their departure after the implementation of the reform, without losing their entitlement to early retirement.

Insured persons with disabilities

The rules on insured persons with disabilities are clarified, with a departure at 55 years and a relaxation of the conditions for departure as such. The necessary insurance period does not increase and the double condition of quarter validated and contributed is deleted in favor of maintaining the sole condition of quarters contributed. The decree introduces the creation of a retirement age of 62 for unfit and disabled insured persons.

Accident at work The pension scheme for permanent incapacity has been adapted to enable self-employed workers who have taken out individual voluntary insurance (AT/MP) to access it.

FYI  

for insured persons who applied for their pension before 1er September 2023, and whose retirement is due to take effect on that date, it will be possible to have their pension or pension application canceled if they so wish until 31 October 2023.
