Family Solidarity Leave in the Public Service

Family solidarity leave allows you to reduce or stop your professional activity to accompany a loved one at the end of life. We will detail the conditions for granting this leave.

Official

You are entitled to family solidarity leave if the following 2 conditions are met:

  • You're in activity or secondment
  • One of your loved ones has a life-threatening condition or is in the advanced or terminal phase of a serious and incurable condition, whatever the cause

Family solidarity leave allows you to reduce or stop your professional activity to accompany this loved one at the end of life.

The person you wish to accompany must be a ascendant, one descendant, a brother, sister, or someone who shares your home or has designated you as his or her trusted person.

The person being accompanied may live in their own home, in your home, in the home of a third party, or by Ehpad: titleContent.

Family solidarity leave may consist, at your choice, of a period of complete cessation of activity or a period of part-time work.

If you completely cease your activity, you can choose to take your leave of absence as follows:

  • In the form of a continuous period of up to 3 months, renewable once
  • Or split-up, as periods of at least 7 consecutive days, whose cumulative duration cannot be more than 6 months

If you choose to reduce your work activity, you can take your leave as part-time at 50%60%, 70% or 80% for a maximum period of 3 months, renewable 1 time.

No minimum leave period is required.

Reminder

Family solidarity leave cannot be deducted from the duration of annual leave.

Family solidarity leave is unpaid.

But you can receive, during part of your leave, a daily support allowance for a person at the end of life.

The amount of the allowance varies depending on whether you are completely out of business or working part-time.

You're shutting down

The amount of the allowance shall be €63.34 per day.

It can be paid to you for Maximum 21 days.

Reminder

Where one or more other persons accompany your loved one at the end of life and also benefit from the support allowance, the total number of daily allowances of the various beneficiaries may not exceed 21.

You work part-time

The amount of the allowance shall be €31.67 per day, regardless of the length of work chosen.

It can be paid to you for Maximum 42 days.

Reminder

Where one or more other persons accompany your loved one at the end of life and also benefit from the support allowance, the total number of daily allowances of the various beneficiaries may not exceed 42.

The allowance is paid to you by your employer's administration for each day of leave, whether it is workable or not.

If the person accompanied is hospitalized after payment of the allowance has begun, the allowance continues to be paid during the days of hospitalization.

You have to make a written request and accompanied by a certificate from the doctor of the sick person.

Your application must include following information :

  • Surname, first name and social security number of the person accompanied and contact details of his social security fund
  • Desired number of daily allocations
  • If applicable, the names of the other beneficiaries of the accompanying allowance and the distribution of the daily allowances among you. The total number of daily allowances of the various beneficiaries may not exceed the maximum number of days allowed (21 days in the case of interruption of activity, 42 days in the case of part-time work)

Your employer administration cannot refuse you leave.

As regards the payment of daily allowances, your employer's administration shall inform, within 48 hours upon receipt of your application, the social security fund to which the person accompanied is subject.

In the absence of response within 7 days from the social security fund, the allowance shall be deemed to have been granted.

Payment of daily allowances shall begin at the end of the month in which the accompanying person's social security fund has given its consent.

If the accompanying person dies before the end of the 7-day period, the allowance is paid to you for the days between the date of receipt of your application and the day after death.

Career

Family solidarity leave is considered to be a period of actual service.

It is therefore taken into account for theadvancement step and grade and for the internal promotion.

It does not reduce your entitlement to other leave, including:

You retain your vested rights before the start of your leave, which you were unable to exercise because of your leave. This includes the right to annual assessment and annual interview and the right to training.

Duration of the course

If you are a probationary official, your probationary period is extended by the same number of days of family solidarity leave used.

Family solidarity leave is fully taken into account in the calculation of the services used for your classification at tenure.

RTT

Family solidarity leave is not taken into account for the calculation of your RTT.

Home transportation costs - Work

Support for commuting costs shall be suspended for any period from one month to the date fully covered by a period of family solidarity leave.

Retirement

The period of leave is taken into account for retirement, if you pay your contributions at the end of the leave.

It is taken into account for the calculation of the number of quarters of pension insurance and for the calculation of the pension.

Contributions are calculated on the basis of the gross index salary you would have received if you had not taken the leave.

These contributions shall be levied each month up to 5% of your net salary.

The 1re withholding is carried out on the treatment of the 1er the full month after you resume business.

You can also choose at any time to pay all the contributions due.

You must then inform your administration by mail.

Family solidarity leave ends at end of maximum allowed time (3 or 6 months) or within 3 days of death the person accompanied.

You can also request the end of your leave before the date originally scheduled. In this case, if you are a hospital worker, you must respect a 3-minute notice free days.

At the end of the break, you get back to your job.

The request for a daily accompanying allowance shall be made in the same conditions as for employees governed by private law.

Family solidarity leave is considered a period of actual service.

It is taken into account for the determination of seniority benefits: review of your pay conditions every 3 years, possibility to enter internal competitions, etc.

Family solidarity leave is not taken into account for the calculation of your RTT.

Support for commuting costs shall be suspended for any period from one month to the date fully covered by a period of family solidarity leave.

Family solidarity leave ends at the end of the maximum allowable duration (3 or 6 months) or within 3 days of death the person accompanied.

You can also request the end of your leave before the date originally scheduled.

At the end of the leave, you return to your job.
