Civil service: family solidarity leave

Family solidarity leave allows a public official to stay with a loved one at the end of their life. It may consist of a temporary cessation of activity (continuous or divided into periods of at least 7 days) or a temporary shift to part-time work. This leave is unpaid. However, staff members may apply for the daily home support allowance for a person at the end of life.

Official

Family solidarity leave may be granted to stay with a family member living at home.

This loved one must have a life-threatening illness or be in the advanced or terminal phase of a serious and incurable illness.

Accompanied person must be a ascendant, one descendant, a sibling or someone who shares your home or has designated you as trusted person.

Family solidarity leave is granted to you, at your choice, in one of the following ways:

  • Continuous period of up to 3 months, renewable 1 time
  • Split periods of at least 7 consecutive days, the cumulative duration of which may not exceed 6 months
  • Part-time at 50%60%, 70% or 80% for a maximum period of 3 months, renewable once.

No minimum duration is required.

Family solidarity leave is granted on written requestaccompanied by a certificate from the doctor of the sick person.

The application shall contain the following information:

  • Desired number of daily allocations
  • Surname, first name and social security number of the person accompanied and contact details of his social security fund
  • If applicable, the names of the other beneficiaries of the accompanying allowance and the distribution of the daily allowances among you. The total number of daily allowances of the individual beneficiaries may not exceed the maximum number of days allowed.

Within 48 hours of receiving your request, the administration shall inform the social security fund to which the person accompanied is subject.

If the social security fund does not reply within 7 days, the allowance shall be considered to have been granted.

If the accompanying person dies before the end of the seven-day period, the allowance shall be paid for the days between the date of receipt of the official's request and the day after death.

Family solidarity leave is unpaid. But you receive a daily home support allowance for a person at the end of life, under the following conditions:

You're quitting his business

The amount of the allowance shall be €59.63 per day for up to 21 days.

You choose part-time

The amount of the allowance shall be €29.82 per day, regardless of the length of work chosen for a maximum of 42 days.

The allowance is paid by your administration for each day of leave, whether it is workable or not.

Payment of daily allowances shall begin at the end of the month in which the accompanying person's social security fund has given its consent.

If the person accompanied is hospitalized after payment of the allowance has begun, the allowance continues to be paid on the days of hospitalization.

Leave is considered to be an actual period of service. It is therefore taken into account for advancement in step and grade and for internal promotion.

It shall not reduce the following leave entitlements:

  • Annual leave
  • Sick leave
  • Maternity or adoption leave
  • Paternity and childcare leave
  • Vocational training leave
  • Leave for validation of experience
  • Skills Check Leave
  • Leave for union training
  • Caregiver leave
  • Representation leave.

If you are a probationary official, your probationary period is extended by the same number of days of family solidarity leave taken.

Family solidarity leave is fully taken into account in the calculation of the services selected for your tenure classification.

Family solidarity leave is not taken into account for the calculation of your RTT.

Support for commuting costs shall be suspended for any period from one month to the date fully covered by a period of family solidarity leave.

The period of leave is taken into account for retirement (for the duration of insurance and the calculation of the pension), if you pay your contributions at the end of the leave.

Contributions are calculated on the basis of the gross salary you would have received if you had not taken the leave.

These contributions shall be levied each month up to 5% of your net salary.

The 1re withholding is carried out on the treatment of the 1er full month after resumption of operations.

You can also choose at any time to pay all the contributions due. You must then inform your administration by mail.

Family solidarity leave shall end at the end of the maximum period allowed (3 or 6 months) or within 3 days of the death of the person accompanied.

You can also request the end of your leave before the date originally scheduled. If you're a hospital worker, you have to give 3 minutes' notice free days.

At the end of the leave, you return to your job.

Contractual

Family solidarity leave can be granted to stay with a family member living at home.

  • Form cerfa no. 14555*01 application for a daily home support allowance for a person at the end of life
  • Attestation by the doctor of the sick person.

The application shall contain the following information:

  • Surname, first name and social security number of the person accompanied and contact details of his social security fund
  • If applicable, the names of the other beneficiaries of the accompanying allowance and the distribution of the daily allowances among you. The total number of daily allowances of the individual beneficiaries may not exceed the maximum number of days allowed.

Within 48 hours of receiving your request, the administration shall inform the social security fund to which the person accompanied is subject.

In the absence of a reply within 7 days from the social security fund, the allowance shall be considered to have been granted.

Family solidarity leave is unpaid. But you get a daily home support allowance for a person at the end of life under the following conditions:

The allowance is paid by the Social Security for each day of leave, regardless of whether workable or not.

Payment of the daily allowances shall commence at the end of the month in which the accompanying person's social security fund has given such agreement.

If the person accompanied is hospitalized after payment of the allowance has begun, the allowance continues to be paid on the days of hospitalization.

Leave is considered to be an actual period of service.

It is therefore taken into account for the determination of seniority benefits.

Family solidarity leave does not affect the number of days of annual leave.

Family solidarity leave is not taken into account for the calculation of your RTT.

The payment of subscription vouchers for travel between home and work shall be suspended for any calendar month fully covered by a period of family solidarity leave.

Family solidarity leave shall end at the end of the maximum period allowed (3 or 6 months) or within 3 days of the death of the person accompanied.

You can also request the end of your leave before the date originally scheduled.

At the end of the leave, you return to your job.
