Annual leave in the public service

Are you a public servant and would like to know the rules concerning annual leave in the public service? We present you the information to know according to your public service of origin (State - FPE, territorial - FPT, hospital - FPH).
EPF
General rule for calculating annual leave
You are entitled, for one year of completed service of 1er January to December 31, paid annual leave of a duration equal to 5 times the number of days worked per week.
This applies whether you are a public servant (trainee or incumbent) or a contract employee and whether you work full-time, part-time or on a non-full-time employment.
This also applies if you are a public servant on secondment.
Example :
If you work full time 5 days a week, you are entitled to 25 days of vacation.
If you work part-time at 80% 4 days a week, you are entitled to 20 days of annual leave.
If you work part-time at 80% 5 days a week (to reduce your daily working hours), you are entitled to 25 days of annual leave.
If you're not working calendar year complete, the duration of your annual leave shall be calculated in proportion to the duration of the services performed. The number of days obtained is rounded up to the next half day if necessary.
Example :
If you work full-time 5 days a week for 9 out of 12 months, you are entitled to 18.75 days of leave, rounded to 19 days (25 x 9 / 12).

Some staff may be subject to special rules (e.g. teachers).
Some leave is considered to be periods of completed service and do not reduce your annual leave entitlements.
These include:
- Leave of absence disease, of long-term illness (CLM), of long life (CLD), leave for temporary invalidity attributable to service (Citis) if you are a public servant
- Leave of absence serious illness, accident at work leave for occupational disease if you are a contractual person
- Leave of absence motherhood or of adoption, 3-day leave for birth or adoption, paternity and childcare leave
- Vocational training leave, for validation of experience, for skills assessment
- Volunteer head of association leave
- Family Solidarity Leave
- Citizenship Leave
- Parental leave
- Caregiver leave.
Additional Days Off
If you take a certain number of vacation days, outside period 1er may - 31 october, you have extra days off (called split days).

Agent under 21
If you have under 21 at 1er January of the year, you can claim full vacation leave even if you have not worked the full year.
In this case, the days granted in addition to your earned leave entitlements are not paid.
Example :
If you worked full time 5 days a week from 1er from january to august 31, you can request 25 days of annual leave but only 17 days out of 25 are paid (25 x 8 /12 = 16.6 rounded to 17).
General rule
The holiday schedule is determined by your department manager, after consultation with all agents.
Leave may be split in the interests of the service.
You cannot be away more than 31 calendar days consecutive.
However, you may exceptionally be allowed to accumulate your leave for more than 31 consecutive days for travel to your country of origin or accompany your spouse to his or her country of origin.
If you're a caregiver, you have priority in choosing your annual leave periods.
Reminder
You can only work during your holidays in some special cases.
Postponement and compensation of leave
Vacation leave may be carried over from one year to the next, only with the exceptional permission of your employer's administration.
However, annual leave not taken due to sick leave or accident in service may be carried over from one year to the next, under certain conditions.
Also under certain conditions, leave not taken in the course of a year may be paid on a Time Savings Account (TSA).
Leave not taken shall not give rise to any compensatory allowance. However, there are exceptions in some cases if you are a contract worker. You are entitled to leave compensation at the end of a CSD: titleContent or in the event of resignation, if you have not been able to take all or part of your leave due to service requirements or for health reasons.
You are also entitled to leave compensation if you have not been able to take all or part of your leave because of service requirements or for health reasons in the event of dismissal for non-disciplinary reasons.
The annual leave allowance shall be equal to 10e of your total gross remuneration received between 1er January and December 31 of the current year. The allowance shall be proportional to the number of days of annual leave not taken. The allowance may not be less than the amount of remuneration you would have received during the period of annual leave due and not taken. It is subject to the same contributions as your remuneration.
The days of recovery of working time (RTT) in the event of the legal working time being exceeded, you are granted the right to work according to the organization of the working time in your assignment department (work cycles, variable hours, flat-rate days).

- Leave of absence serious illness, accident at work leave for occupational disease if you are a contractual person
- Leave of absence motherhood or of adoption, 3-day leave for birth or adoption, paternity and childcare leave
- Vocational training leave, for validation of experience, for skills assessment

You are also entitled to 1 additional day off if you take your annual leave in at least 3 periods of at least 5 days each.

The estimated holiday schedule shall be drawn up by your head of department, after consulting all staff and taking into account the service requirements.
It shall be made available to the staff no later than 31 March every year.
You can enjoy 3 consecutive weeks of annual leave during the summer period, unless the service is strictly operational.
