Monitoring of pupils in primary school (kindergarten or elementary)

Verified 24 April 2024 - Directorate for Legal and Administrative Information (Prime Minister)

By depositing your child at school, you entrust the responsibility to the staff of the school to look after him. The school must keep an eye on your child and guarantee their safety. What is the scope of this monitoring obligation? Here's the information you need to know.

At nursery school

The school principal is responsible for organizing the reception and supervision of pupils.

The teachers must supervise students during school hours and other activities supervised by them.

Other people also have an obligation to supervise when they participate in the supervision of pupils. For example: a communal officer placed at the disposal of the establishment, an external worker during a sporting activity, a volunteer escort during a school trip.

Your child should be supervised during all school time, i.e. throughout the period when it is entrusted to the establishment.

Monitoring is continuous whatever the activity carried out and the place where it is carried out (during the course, recreation or outdoor activities organized as part of the school activity).

The supervision service at the reception, at the exit of the classes and during the breaks is divided between the teachers. A table indicating the organization of the surveillance shall be displayed in the school.

Childcare

Your children are welcomed 10 minutes before the start of each half-day of class. The school can extend hours to better control student entry and reduce waiting time on the public highway.

Before the care of the staff of the school, the child is under the responsibility of the person accompanying him to the school.

Monitoring the presence of children

The teacher checks the pupils present and absent every day.

In case ofabsence of your child, you must inform the principal as soon as possible. If this is a foreseeable absence, you must inform the institution in advance with the reason.

When the teacher notices your child's absence, he or she will report it to the school management that is notifying you (if this absence was not planned).

The delivery of a medical certificate is necessary only in case of contagious diseases. You must then pass it on to the school as soon as your child returns to class.

Monitoring children during school activities

Students should be monitored for all school activities which take place in the establishment.

Teachers supervise students until they are taken over by the canteen or daycare. The responsibility is then transferred to the organizer of the activity extracurricular.

Example :

the city hall is responsible for monitoring students attending school in the public during the canteen.

Pupils who are not supported by extra-curricular services remain under the supervision of a person designated by the school director until the school leaves.

Leaving school

Your child is given to you directly. The people you designated in writing at the beginning of the school year can also collect the child. The school management cannot oppose the choice of the persons responsible for recovering the child. No age requirement may be imposed by the school.

If you are regularly late for school leaving, a dialog is set up to take into account your difficulties and find solutions. If the delays do not stop, your child may be temporarily excluded from school.

The school principal may also report these breaches to the department's services in the context of a information of concern. It is a child protection measure intended to inform the department of the existence of a danger or risk of danger to a minor.

Special Security Plan (PPMS)

The school must also put in place a special security plan (PPMS). This system must make it possible to ensure the safety of pupils and staff in the event of intrusion into the school in particular.

Each year, 2 PPMS-type exercises (shelter or confinement) are organized in the school.

Students must be monitored during organized group travel outside the hotel.

Travel during school time

During school time, movement of pupils between school and the place of school activity (for example: the swimming pool, the gym, the conservatory) must be supervised.

School trips and trips

Students should be monitored for for the entire duration of the field trip or school trip.

If your child is the victim of harm caused by a lack of supervision, you can seek redress in court.

Depending on the circumstances (fault of the staff member, lack of organization, etc.), it is the staff member's or the State's responsibility that will be brought before the civil courts or administrative.

In exceptional cases, it may be brought before the criminal court.

Compensation may be awarded to your child for damages (injuries, damaged property, etc.).
