Foreigner's "private and family" residence card in France

You are a non-European foreigner and you have family ties in France? You can obtain a personal and family residence card under certain conditions. How to ask for the card? What documents should be provided? How much is the residence card? We present you the necessary information according to your situation (husband of French, married with a French, parent of a French child, member of the family of a foreigner staying regularly in France,...).

Attention: you are concerned by another residence permit if you are European or Algerian.

1st Request

The residence card family life allows you to stay in France. She allows you to work. Your employer does not have to apply for work authorisation.

You have a long-stay visa (VLS-TS)

You can ask for the residence card multiannualfamily life 2e year of your stay in France, in renewal of your VLS-TS (valid for 1 year).

You must complete all of the following conditions ::

  • The community with your spouse must not have stopped (she may have stopped in case of death or domestic violence)
  • Your spouse must be French on the day of marriage and must have retained French nationality
  • You must not live in a polygamy
  • If wedding was celebrated abroad, it must be transcribed on the registers of civil status of the French consulate in order to be recognised in France

You entered France on a short-stay visa

The "private and family life" residence card may exceptionally you will be issued if you meet the following conditions:

  • You don't live in polygamy
  • You are married in France with a French national with whom you justify a common and effective life of 6 months in France

The residence card issued to you is valid 1 Year.

You have another residence permit

The residence card temporaryfamily life can be granted as part of a status change at the end of another card (as student, employee, etc.)

2nd step: Make an appointment

You must submit your card application to the prefecture (or sub-prefecture) of your home, 2 months before the end of your visa (or residence permit).

Step 3: Buy the tax stamp

You have to pay €225 (stamp duty of €25 and tax €200) by tax stamps.

If you have entered without a long-stay visa, you must pay extra €200 of the right of visa for regularisation by tax stamps (including €50 to be paid upon filing of the application and not refundable in the event of refusal to issue the security).

You will need to provide proof of payment upon delivery of the card.

Step 4: Prepare the documents to be provided

  • Medical certificate issued by theOfii: titleContent (to be remitted at the time of delivery of the security)
  • Statement on the honour of no polygamy in France if you are married and are a national of a country that allows it
  • Full copy of the marriage certificate or transcript of the marriage certificate celebrated abroad (if you do not have a long-stay visa, a marriage in France is required)
  • Declaration on joint honour attesting to your common life plus all documents allowing to establish a community of life of at least 6 months in France (lease contract, EDF receipt, RIB: titleContent, etc.)
  • If the common life has been broken due to death or domestic or family violence: death certificate, filing of complaint, divorce judgement for fault, conviction of the spouse for violence.

FYI  

foreign-language civil status documents must be accompanied by their translation into French by a certified interpreter. In some cases, these acts should also be legalised (apostille or legalisation by the French consulate abroad).

5th step: Go to the appointment

You must go to this appointment in person.

If your file is complete, you will receive a revived pending the prefecture's response.

Please note

your french-speaking spouse must be present at the time of appointment or filing in the prefecture (except in cases of domestic violence).

Step 6: Delivery of the residence card once it is available

You are informed by the prefecture that your title is available.

The card is given to you by the prefecture or sub-prefecture of your home (depending on the place where your application is submitted).

In most prefectures, you have to make an appointment.

The residence card multiannual is valid 2 yrs.

Step 7: What to do if you refuse?

If you meet the conditions for issuing the residence card, the prefect must enter the residence permit committee for opinion, if he plans to refuse to issue you the card.

In order to be heard by the committee, you will receive a notice by mail at least 15 days before its meeting date.

You are informed of your right:

  • be assisted by a lawyer or any person of your choice,
  • be heard with the assistance of an interpreter,
  • and possibly benefit during this procedure legal aid.

You can explain the reasons and circumstances of your application for a residence permit.

You also have the right to request that the mayor of your municipality of residence (or his or her representative) be present and heard.

If you do not have a residence card or if your card is out of date, you will be given a provisional residence document.

Your explanations are sent to the Prefect with the reasoned opinion of the Committee on the residence permit. The opinion of the commission is also communicated to you.

The decision of the Prefect is yours notified by reasoned letter (explicit decision). Except where otherwise provided, such refusal shall be accompanied by obligation to leave French territory (OQTF) fixing the country where you will be returned.

You can form a litigation before the administrative tribunal (within 48 hours, 15 days or 30 days depending on the type of OQTF).

No reply from the Prefect on your request

If the prefecture did not respond after 4 months, it is an implicit refusal.

  • Proof of your contribution to the maintenance and education of your child since birth or for at least 2 years: payment of a pension, proof of purchases (food, clothing, toys, etc.), attestations (accommodation, school follow-up, etc.), proof of the real affective link (interest in the child's development, knowledge of his or her environment, real affective presence, testimonies, etc.)
  • If parentage towards the French parent results from parentage recognition:
    • supporting documents proving that the French parent has effectively contributed to the maintenance and education of the child since birth or for at least 2 years (payment of a pension, purchases intended for the child, food or clothing, leisure, educational, accreditation, toys), regular accommodation, interest in the child's schooling, real emotional presence, testimonials, etc.

Your spouse has been living in France for at least 18 months with a residence permit

You are subject to the family reunion.

The private and family residence card allows you to stay in France and work there. Your employer does not have to apply for work authorisation.

Application for family reunification

Please note

if you are a child of a foreigner, who entered France as a minor through family reunification, you can obtain the "private and family life" card from the age of 18 (or 16 if you want to work).

Your spouse has a "talent passport"

You can obtain a multi-year residence card family talent passport. Your children receive the same card at age 18 (or 16 if they want to work).

The duration of this card is equal to the remaining period of validity of your stay in France with your spouse(s). It entitles the holder to pursue any professional activity.

Your spouse has a long-term resident - EU residence card

You can obtain the residence card private and family life.

This card allows you to stay in France. It shall not be entitled to pursue a professional activity in the year following its first issue, unless you entered France as a minor and have been resident in France for at least 1 year.

You are concerned if you are a foreigner with long-term resident-EU in another EU country. You must ask for the card within 3 months of your entry into France. Your children receive the same card at age 18 (or 16 if they want to work).

Please note

you must prove that you have legally resided with the long-term EU resident in the other Member State and that you have health insurance. You must have stable and sufficient resources or you must be supported by your EU long-term resident spouse or parent.

Other personal and family links in France

You can ask for the residence card family life if you justify intense, old and stable personal and family ties in France.

You will also have to justify your republican insertion in French business and your living conditions in France. Finally, you will have to prove the nature of your relationship with your family in your country of origin. You must not live in a state of polygamy.

    • Parental and collateral links: extracts of birth certificates of parents and siblings with parentage, adoption or guardianship judgement (documents corresponding to the situation at the time of application)
    • Professional or personal links: employment contract, payroll, participation in local/associative life, etc.
    • Justifications for the regular stay in France of the family members: copy of the residence card or the national identity card
    • Proof by all means of the maintenance of certain and continuous relations with the members of the family settled in France (children, husband, partner or partner)
    • All documents enabling the assessment of habitual residence in France: visa, certificate of application for a residence card, certificate of application for asylum, documents of a public administration (prefecture, social service, school), documents of a private institution (medical certificate, bank statements, etc.), certificates of relatives.

Your explanations are sent to the Prefect with the reasoned opinion of the Committee on the residence permit. The opinion of the commission is also communicated to you.

the prefect may decide not to issue the card to you, even if the commission has given a favourable opinion.

The deadlines for challenging are different depending on whether you have received a response from the prefecture.

If the prefect has notified you of the refusal

The decision of the Prefect is yours notified by reasoned letter (explicit decision). Except where otherwise provided, such refusal shall be accompanied by obligation to leave French territory (OQTF) fixing the country where you will be returned.

You can form a litigation before the administrative tribunal (within 48 hours, 15 days or 30 days depending on the type of OQTF).

No reply from the Prefect on your request

If the prefecture did not respond after 4 months, it is an implicit refusal.
